HomeMy WebLinkAboutORD 2492BILL NO.6 ORDINANCE NO. 2492 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE C -1 (NEIGHBORHOOD COMMERCIAL) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 1451, approved Case No. ANN- 86P -04 and SUB- 99P -04 (Caldwell Family YMCA) at a public hearing held March 1, 2004. Section 2. The property is located at the southeast corner of Ustick Road and Montana Avenue. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as a C -1 (Neighborhood Commercial) zone: A portion of the southeast quarter of the southeast quarter of Section 34, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho, being more particularly described as follows: Beginning at the northeast corner of the southeast quarter of the southeast quarter of said Section 34, which is the Real Point of Beginning: Thence S00 °27'1 0 "W, 617.20 feet along the easterly boundary of the southeast quarter of the southeast quarter of said Section 34; Thence N89 0 53'22 "W, 300.61 feet; Thence S00 0 26'38 "W, 100.00 feet; Thence N89 0 53'22 "W, 404.34 feet; to the centerline of the Dixie Drain; Thence N32 0 05'32 "W, 400.94 feet along said centerline of the Dixie Drain; Thence N14 0 16'32 "W, 80.88 feet along said centerline of the Dixie Drain; Thence N49 °26'24 "E, 21.36 feet to the centerline of the High Line Canal; Thence N33 °53'46 "W, 343.89 feet along said centerline of the High Line Canal; Thence S89 0 55'09 "E, 1,119.12 feet along the northerly boundary of the southeast quarter of the southeast quarter of said Section 34 to the Real Point of Beginning. Comprising 14.31 acres, more or less. Section 3. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as an C -1 (Neighborhood Commercial) zone. Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled.
