ORDINANCE NO. 2485
AN ORDINANCE TO PROVIDE A C -1 (NEIGHBORHOOD COMMERCIAL) ZONE DESIGNATION FOR
CERTAIN LANDS; DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY
OF CALDWELL, IDAHO; INSTRUCTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT
DIRECTOR TO DESIGNATE SAID PROPERTY AS C -1 ON THE OFFICIAL ZONING MAP AND
OTHER AREA MAPS OF THE CITY REPEALING ALL LAWS ORDINANCES AND RESOLUTIONS IN
CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY
OF CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation of
the Caldwell Planning and Zoning Commission that Case No. ZON- 34 -03, a request by Russell Snow to
rezone certain property, and following the public notice and hearing procedures as required by Idaho
Code, Chapter 65 Local Planning Act, that the following described property be zoned C -1 (Neighborhood
Commercial) and that said zoning designation is in the best interest of the City of Caldwell, Idaho.
Section 1. The site abuts the south side of Logan Street, approximately 350 feet west of Kimball
Avenue, extends 300 feet southward. It is also known as 115 and 123 West Logan Street. The property
is inside the corporate boundaries of the City of Caldwell, and the Applicant has requested this site to be
rezoned as C -1 (Neighborhood Commercial):
A part of Section 28, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho, being
parts of Blocks 16 and 42 of the PIONEER SUBDIVISION, according to the plat filed in Book 4 of Plats,
Page 52, records of said County, and more particularly described as follows:
BEGINNING at a point 329.71 feet West of the center of the intersection of Logan Street and South
Kimball Avenue, Caldwell, Idaho, which intersection is the Northeast corner of the Northeast Quarter of
the Northwest Quarter of the Southeast Quarter of Section 28, Township 4 North, Range 3 West, Boise
Meridian, Canyon County, Idaho; thence at right angles; South a distance of 305 feet; thence at right
angles; East parallel with Logan Street a distance of 75 feet; thence at right angles; North a distance of
305 feet to the center of Logan Street; thence West along the center of Logan Street a distance of 75
feet to the POINT OF BEGINNING.
BEGINNING at a point 165 feet West of center of intersection of Logan Street and South Kimball
Avenue, Caldwell, Canyon County, Idaho, which intersection center is the Northeast corner of Northeast
Quarter of the Northwest Quarter of the Southeast Quarter of Section 28, Township 4 North, Range 3
West of the Boise Meridian, Canyon County, Idaho; thence at right angles; South 305 feet; thence at
right angles; West 89.71 feet; thence at right angles; North 305 feet to the center of Logan Street; thence
at right angles; East 89.71 feet to PLACE OF BEGINNING.
Section 2. That the City Engineer and the Community Development Director of the City of Caldwell,
Idaho, are hereby instructed to so designate the same above described property on the official zoning
map and other area maps of the City of Caldwell, Idaho as a C -1 (Neighborhood Commercial) zone.
Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 4. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
