ORDINANCE NO. 2482
AN ORDINANCE TO PROVIDE A C -3 (SERVICE COMMERCIAL) ZONE DESIGNATION FOR
CERTAIN LANDS; DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY
OF CALDWELL, IDAHO; INSTRUCTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT
DIRECTOR TO DESIGNATE SAID PROPERTY AS C -3 ON THE OFFICIAL ZONING MAP AND
OTHER AREA MAPS OF THE CITY REPEALING ALL LAWS ORDINANCES AND RESOLUTIONS IN
CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY
OF CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation of
the Caldwell Planning and Zoning Commission that Case No. ZON- 35 -03, a request by Jerry Gunstream
to rezone certain property, and following the public notice and hearing procedures as required by Idaho
Code, Chapter 65 Local Planning Act, that the following described property be zoned C -3 (Service
Commercial) and that said zoning designation is in the best interest of the City of Caldwell, Idaho.
Section 1. The site is generally located at the southwest corner of the intersection of S. 21 st Avenue and
Chicago Street and abuts the northeast side of the Oregon Shortline Railroad right -of -way. The property
is inside the corporate boundaries of the City of Caldwell, and the Applicant has requested this site to be
rezoned as C -3 (Service Commercial):
A portion of NW %, Section 26, TAN., R.3W., B.M., Canyon County, Idaho, more particularly described
as follows:
Commencing at the section corner common to Sections 22, 23, 26 and 27, TAN., R3W., B.M., Canyon
County, Idaho and running S. 0°43'12 "W. 447.20 feet along the Section line common to Sections 26 and
27 to a point on the center line of Chicago Street; thence South 46 °13'58" East 1,009.86 feet along said
center line of Chicago Street to a point on the center line of North 21 Avenue; thence South 43 0 46'32"
West 40.00 feet along said center line of North 21 Avenue to a point; thence North 46 0 13'58" West
30.00 feet to a point on the Northwesterly right of way line of said North 21 st Avenue, said point being the
TRUE POINT OF BEGINNING; thence continuing North 46 0 13'58" West 443.82 feet to a point; thence
South 43 0 45'05" West 453.14 feet to a point on the center line of Indian Creek; thence along said center
line of Indian Creek the following courses and distances:
Continuing North 47 °30'08" West 238.48 feet to a point; thence North 59 0 30'37" West 67.76 feet to a
point; thence North 77 °20'32" West 39.98 feet to a point; thence South 89 21' 23" West 165.44 feet to a
point; thence leaving said center line of Indian Creek and running North 74 16'49" West 39.02 feet to a
point; thence North 82 17' 48" West 353.81 feet to a point on the Northeasterly right -of -way line of the
Union Pacific Railroad; thence South 46° 14'41" East 1220.80 feet along said Northeasterly right -of -way
line of Union Pacific Railroad to a point on the said Northwesterly right -of -way line of North 21 Avenue;
thence North 43 46' 32" East 836.79 feet along said Northwesterly right -of -way line of North 21S Avenue
to the TRUE POINT OF BEGINNING. (containing 13.08 acres, more or less)
Section 2. That the City Engineer and the Community Development Director of the City of Caldwell,
Idaho, are hereby instructed to so designate the same above described property on the official zoning
map and other area maps of the City of Caldwell, Idaho as a C -3 (Service Commercial) zone.
Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
