ORDINANCE NO. 2474
AN ORDINANCE TO PROVIDE A M -1 (LIGHT INDUSTRIAL) ZONE DESIGNATION FOR CERTAIN
LANDS; DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY OF
CALDWELL, IDAHO; INSTRUCTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT
DIRECTOR TO DESIGNATE SAID PROPERTY AS M -1 ON THE OFFICIAL ZONING MAP AND
OTHER AREA MAPS OF THE CITY REPEALING ALL LAWS ORDINANCES AND RESOLUTIONS
IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY
OF CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation
of the Caldwell Planning and Zoning Commission that Case No. ZON- 30 -03, a request by Caldwell
East Urban Renewal Agency to rezone certain property, and following the public notice and hearing
procedures as required by Idaho Code, Chapter 65 Local Planning Act, that the following described
property be zoned M -1 (Light Industrial) and that said zoning designation is in the best interest of the
City of Caldwell, Idaho.
Section 1. The property is located south of Franklin Road, east of Aviation Way, west of Smeed
Parkway and north of Linden Street. The east side of the property fronts along Smeed Parkway for
approximately 640 feet. The parcel is inside the corporate boundaries of the City of Caldwell, and the
Applicant has requested this parcel be rezoned as M -1 (Light Industrial) zone:
A portion of the West 112 NW 114 of section 25, Township 4 North, Range 3 West, Boise Meridian,
Caldwell, Canyon County Idaho, and Lots 1 through 4 and a portion of Lots 5, 6, 13, 14, 15 & 16 of
Parks Orchard Tracts as on file in Book 3 of Plats at Page 19 in the Office of the Recorder of Canyon
County, Idaho, and more particularly described as follows:
Commencing at the NW corner of the West 112 NW 114 (Section comer common to sections 23, 24,
25 and 26) said corner monumented with a 3 inch diameter brass disk; Thence N. 89° 49' 29" E., a
distance of 1328.80 feet along the northerly boundary of said West 112 NW 114 to the NE corner of
said West 112 NW 114 (W 1116 corner), said corner monumented with a 518 inch diameter iron pin;
Thence S. 0° 34' 02" W., a distance of 1263.56 feet along the easterly boundary of said West 112 NW
114 to the POINT OF BEGINNING, said point monumented with a 5/8 inch diameter iron pin; Thence
continuing S. 0 34' 02" W., a distance of 1382.00 feet along the easterly boundary of said West 1/2
NW 114 to the SE corner of said West 1/2 NW 114, (CW 1116 corner), said corner also being the NE
corner of Lot 5 of said Parks Orchard Tracts; Thence N. 89 36' 27" E., a distance of 1323.44 feet
along the northerly boundary of Lots 1 through 4 of said Parks Orchard Tracts and also along the
northerly boundary of said North 1/2 of the SW 114 to the NE corner of said North 1/2 of the SW 1/4
(Center 114 corner), said corner monumented with a 518 inch diameter iron pin; Thence S. 0° 41' 17"
W., a distance of 578.43 feet along the easterly boundary of said Parks Orchard Tracts and easterly
boundary of said North 1/2 of the SW 114 to a point on the Old Caldwell Ditch as shown on said Parks
Orchard Tracts, said point monumented with a 518 inch diameter iron pin; Thence continuing along
said Old Caldwell Ditch the following courses and distances: Thence S. 53 19' 14" W., a distance of
100.25 feet to a 5/8 inch diameter iron pin; Thence S. 36 07' 59" W., a distance of 471.49 feet to a
518 inch diameter iron pin; Thence S. 35 55' 31" W., a distance of 382.59 feet to a point on the
southerly boundary of said Parks Orchard Tracts and the southerly boundary of said North 112 of the
SW 114, said point monumented with a 518 inch diameter iron pin; Thence leaving said Old Caldwell
Ditch and along a portion of the southerly boundaries of said Lots 14 and 15 of said Parks Orchard
Tracts, and also along the southerly boundary of said North 112 of the SW 114, S. 89 34' 28" W., a
distance of 307.48 feet to a 5/8 inch diameter iron pin; Thence departing the southerly boundaries of
said NE 1/4 SW 114 and said Lot 14, N. 35° 39' 34" W., a distance of 743.88 feet to a point on the
westerly boundary of said NE1 /4 SW1/4, said point also lying on the westerly boundary of said Lot 13
of Parks Orchard Tracts and monumented with a 518 inch diameter iron pin; Thence N. 0 36' 12" E., a
