AN ORDINANCE TO PROVIDE AN R -1 (SINGLE FAMILY RESIDENTIAL) ZONE AND C-4
(FREEWAY COMMERCIAL) ZONE DESIGNATION FOR CERTAIN LANDS; DETERMINING THAT
SAID ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING
THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO DESIGNATE SAID
PROPERTY AS R -1 AND C-4 ON THE OFFICIAL ZONING MAP AND OTHER AREA MAPS OF
THE CITY REPEALING ALL LAWS ORDINANCES AND RESOLUTIONS IN CONFLICT
HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY
OF CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation
of the Caldwell Planning and Zoning Commission that Case No. ZON- 28 -03, a request by Hubble
Homes to rezone certain property, and following the public notice and hearing procedures as required
by Idaho Code, Chapter 65 Local Planning Act, that the following described property be zoned as R -1
(Single Family Residential) and C-4 (Freeway Commercial) zones respectively and that said zoning
designation is in the best interest of the City of Caldwell, Idaho.
Section 1. The property is generally located The property is generally located on the west side of
Aviation Way near the intersection of Hwy. 20126 and Aviation Way. The parcels are inside the
corporate boundaries of the City of Caldwell, and the Applicant has requested these lots to be
rezoned as R -1 (Single Family Residential and C -4 (Freeway Commercial) respectively:
Parcel 1 - R -1 Zone - A parcel of land being a portion of the SE114 of Section 23, TAN., R.3W., B.M.
and portions of Lots 1 and 16 of Hillcrest Subdivision, as same is recorded in Book 3 of Plats at Page
10, records of Canyon County, Idaho, and portions of unopened public right -of -way as shown on said
plat and shown on Record of Survey, Instrument No. 200257653, more particularly described as
follows: Commencing at the corner common to Sections 23, 24, 25 and 26 of TAN., R.3W., from
which the 114 corner common to said Sections 23 and 26 bears North 89 0 58'32" West, 2635.03 feet;
thence along the East boundary of said Sections 23 North 00 °34'57" East, 1005.68 feet to the REAL
POINT OF BEGINNING, thence North 89 0 58'17" West, 676.09 feet; thence 351.43 feet along the arc
of a curve to the left having a radius of 300.00 feet, a central angle of 67 0 07'04" and a long chord
bearing South 56 °28'11" West, 331.68 feet; thence South 22 °54'39" West, 246.90 feet; thence 97.98
feet along the arc of a curve to the left, having a radius of 300.00 feet, a central angle of 18 °42'48"
and a long chord bearing South 13 °33'15" West, 97.55 feet; thence North 89 °58'32" West, 509.55
feet to a point in the center of the Canyon Hill Lateral, said point being witnessed by a 112" iron pin
with cap, PLS 6373 which bears South 89 °58'32" East, 9.00 feet; thence generally along the center of
said lateral the following courses and distances: North 17 °30'32" East, 284.91 feet; North 40 °54'06"
East, 257.36 feet; North 44 0 33'05" East, 177.36 feet; North 30 0 32'00" East, 52.60 feet; North
14 °06'33" East, 52.77 feet; North 3 °31'45" East, 40.81 feet; North 9 0 13'09" West, 102.12 feet; North
12 °16'36" West, 134.16 feet; North 2 °51'08" West, 112.73 feet; thence 138.44 feet along the arc of a
curve to the left, having a radius of 230.00 feet, a central angle of 34 °29'14" and a long chord bearing
North 22 °00'38" West, 136.36 feet; North 37 0 30'25" West, 99.49 feet to a point on the East boundary
of said Hillcrest Subdivision; thence continuing along the center of said Canyon Hill Lateral through
said Lots 1 and 16 North 45 °59'09" West, 123.18 feet; North 32 °57'00" West, 147.24 feet; North
34 °15'39" West, 126.85 feet; thence 211.76 feet along the arc of a curve to the left, having a radius of
750.00 feet, a central angle of 16 °10'39" and a long chord bearing North 41 °02'20" West, 211.06 feet;
