HomeMy WebLinkAboutORD 2463a - INSTRUMENT NO. 02 vc) 3 a 3 5o J 90o 3 2- 5 3 4 10 BILL NO. 10 old ORDINANCE NO. 2463 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS O F T HE CITY OF C ALDWELL, C OUNTY O F C ANYON, S TATE O F I DAHO, AND THAT S AID L ANDS S HOULD B E ANNEXED T O T HE C ITY O F C ALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE - FAMILY) ZONE DISTRICT; AND DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission, and following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 1451, approved Case No. ANN -79 -03 (Apple Creek Sub) at a public hearing held April 21, 2003. Section 2. The property abuts the west side of Montana Avenue approximately 1500 feet south of Ustick Road, extends south approximately 1900 feet, and west approximately 1320 feet. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following d escribed p roperty s hould be a nnexed i nto the C ity of C aldwell a s a n R-1 (Single - Family Residential) zone: The North Half of the Northeast Quarter of the Southwest Quarter and the Southeast Quarter of the Northwest Quarter, in Section 3, Township 3 North, Range 3 West of the Boise Meridian, Canyon County, Idaho. EXCEPTING THEREFROM: A portion of the Southeast Quarter of the Northwest Quarter of Section 3, Township 3 North, Range 3 West of the Boise Meridian, Canyon County, Idaho and is more particularly described as follows: BEGINNING at the Northeast corner of said Southeast Quarter of the Northwest Quarter; thence South 0 07' 19" East along the East boundary of said Southeast Quarter of the Northwest Quarter a distance of 100.00 feet; thence South 89 17' 47" West parallel with the North boundary of said Southeast Quarter of the Northwest Quarter a distance of 1,322.77 feet to a point on the West boundary of said Southeast Quarter of the Northwest Quarter; thence North 0 12' 46" West along said West boundary a distance of 100.00 feet to the Northwest corner of said Southeast Quarter of the Northwest Quarter; thence North 89 17'47" East along the said North boundary a distance of 1,322.92 feet to the POINT OF BEGINNING. Section 3.
