AN ORDINANCE TO PROVIDE A R-2 (MEDIUM DENSITY RESIDENTIAL)ZONE DESIGNATION FOR
CERTAIN LANDS;DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY OF
CALDWELL,IDAHO;INSTRUCTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR
TO DESIGNATE SAID PROPERTY AS R-2 ON THE OFFICIAL ZONING MAP AND OTHER AREA MAPS OF
THE CITY REPEALING ALL LAWS ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED,BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,COUNTY OF
CANYON,STATE OF IDAHO:
WHEREAS,it has been determined by the City Council of the City of Caldwell upon recommendation of the
Caldwell Planning and Zoning Commission that Case No.ZON-25-02,a request by Crestline Development,LC
and Heartland Development, LLC,to rezone certain property,and following the public notice and hearing
procedures as required by Idaho Code,Chapter 65 Local Planning Act, that the following described property be
zoned R-2 (Medium Density Residential)zone and that said zoning designation is in the best interest of the City
of Caldwell,Idaho.
Section 1.The property is located at the NE corner of the intersection of KCID Road and Highway 20/26
Avenue.The parcel is inside the corporate boundaries of the City of Caldwell,and the Applicant has requested
this parcel to be rezoned as R-2 (Medium Density Residential)zone:
A parcel of land situated in a part of Government Lot 4 of Section 19,Township 4 North,Range 2 West,Boise
Meridian,Caldwell,Canyon County Idaho,more particularly described as follows:
Commencing at the SW corner of said Government Lot 4,(Section corner common to sections 19,24,25 and
30),said corner monumented with a 3 inch diameter brass disk;Thence N. 0° 40'31"E.,a distance of 355.46
feet along the westerly boundary of said Government Lot 4 to the POINT OF BEGINNING;Thence continuing N.
0°40"31"E.,a distance of 80.00 feet along the westerly boundary of said Government Lot 4 to the SW
boundary corner of "Virginia Park Subdivision No.1.At The Colonies"as on file in Book 31 of Plats at Page 13
in the Office of the Recorder of Canyon County,Idaho,said corner monumented with a found 5/8 inch diameter
iron pin;Thence along the southerly boundary of said "Virginia Park Subdivision No.1 At The Colonies"the
following courses and distances:Thence leaving the west boundary of said Government Lot 4,S.89°50'21"
E.,a distance of 40.00 feet parallel with the southerly boundary of said Government Lot 4 to a found 5/8 inch
diameter iron pin;Thence S 0°40'31"W.,a distance of 59.77 to a found 5/8 inch diameter iron pin;Thence S.
89°50'21"E.,a distance of 20.00 feet parallel with the southerly boundary of said Government Lot 4 to a found
5/8 inch diameter iron pin;Thence N. 0° 40'31"E,a distance of 79.77 feet parallel with the westerly boundary
of said Government Lot 4 to a found 5/8 inch diameter iron pin;Thence S.89°50'21"E.,a distance of 865.00
feet parallel with the southerly boundary of said Government Lot 4 to a found 5/8 inch diameter iron pin;Thence
49.16 feet along the arc of a 225.00 foot radius tangent curve left with a central angle of 12°31'08"and
tangents of 24.68 feet,the long chord of which bears N.83°54"06"E.,a distance of 49.06 feet to a point of
reverse curvature,said point monumented with a found 5/8 inch'diameter iron pin;Thence 14.11 feet along the
arc of a 20.00 foot radius tangent curve right with a central angle of 40°24'45"and tangents of 7.36 feet,the
long chord of which bears S.82°09'06"E.,a distance of 13.82 feet to a point of reverse curvature,said point
monumented with a found 5/8 inch iron pin;Thence 93.78 feet along the arc of a 50.00 foot radius tangent curve
left with a central angle of 107°27'38"and tangents of 68.14 feet,the long chord of which bears N.64°19'27"
E.,a distance of 80.62 feet to a point of reverse curvature,said point monumented with a found 5/8 inch iron
pin;Thence 14.11 feet along the arc of a 20.00 foot radius tangent curve right with a central angle of 40°24'45"
and tangents of 7.36 feet,the long chord of which bears N.30°48'00"E.,a distance of 13.82 feet to a 5/8 inch
diameter iron pin;Thence 31/42 feet along the arc of a 225.00 foot radius tangent curve left with a central angle
of 8°00"07"and tangents of 15.74 feet,the long chord of which bears N.47°00'19"E.,a distance of 31.40 feet
to a point of reverse curvature,said point monumented with a found 5/8 inch diameter iron pin;Thence S.38°
27"00"E.,a distance of 125.95 feet to a found 5/8 inch diameter iron pin;Thence S.32°50'00"E.,a distance
of 67.99 feet to a found 5/8 inch diameter iron pin;Thence S.0°40'31"W.,a distance of 16.55 feet parallel with
the westerly boundary of said Government Lot 4 to a 5/8 inch diameter iron pin;Thence leaving the southerly
boundary of said "Virginia Park Subdivision No.1 At The Colonies",N.89°50"21"W., a distance of 1206.34
feet with the southerly boundary of said Government Lot 4 to the POINT OF BEGINNING.This parcel contains
2.75 acres more or less.
Section 2.That the City Engineer and the Community Development Director of the City of Caldwell,Idaho,are
hereby instructed to so designate the same above described property on the official zoning map and other area
maps of the City of Caldwell,Idaho as a R-2 (Medium Density Residential)zone.
Section 3.All ordinances,resdfctions,orders or parts thereof in conflig^erewith are hereby repealed,rescinded and annulled.^^
Section 4.This ordinance shall be in full force and in effect from and after its passage,approval and
publication,according to law.
