ORDINANCE NO. 2453
AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, A MUNICIPAL CORPORATION, STATE OF IDAHO, BY DELETING
SECTION 8, ARTICLE 13 OF CHAPTER 1 REGARDING ADOPTION OF 1997
UNIFORM FIRE CODE AND ADDING A NEW SECTION 8, ARTICLE 13 OF
CHAPTER 1 REGARDING THE 2000 INTERNATIONAL FIRE CODE AND
CHANGING ALL REFERENCES IN SECTION 8, ARTICLE 13 FROM 1997
UNIFORM FIRE CODE TO 2000 INTERNATIONAL FIRE CODE (AS
SPECIFICALLY IDENTIFIED WITHIN) AND DELETING SECTION 8, ARTICLE
13, OF CHAPTER 13 REGARDING AMENDMENTS TO THE 1997 UNIFORM FIRE
CODE AND ADDING A NEW SECTION 8, ARTICLE 13, OF CHAPTER 13
REGARDING AMENDMENTS TO THE 2000 INTERNATIONAL FIRE CODE AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF
IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF
IDAHO:
Section 1. That Section 8 of Chapter 13, Article 1, ADOPTION OF 1997
UNIFORM FIRE CODE be deleted in full and a new Section 8 of Chapter 13, Article 1
be added as follows:
08- 13 -01: ADOPTION OF THE 2000 INTERNATIONAL FIRE CODE. There is
hereby adopted by the Mayor and City Council of the City of Caldwell, County of
Canyon, State of Idaho for regulating and governing the safeguarding of life and property
from fire and explosion hazards arising from the storage, handling and use of hazardous
substances, materials and devices, and from conditions hazardous to life or property in
the occupancy of buildings and premises in the City of Caldwell, that certain code and
standards known as the 2000 International Fire Code, including Appendix Chapters A, B,
C, D, E, F, and G, as published by the International Code Council, save and except such
portions as hereinafter deleted, modified or amended by Section 08 -13 -13 of this Article
are now on file in the office of the Caldwell Fire Department, and the same are hereby
adopted and incorporated as fully as if set out at length herein. From the date this Article
shall take effect, the provision thereof shall be controlling within the limits of the City of
Caldwell, County of Canyon, State of Idaho.
Section 2. That Section 8 of Chapter 13, Article 3, ESTABLISHMENT AND
DUTIES OF BUREAU OF FIRE PREVENTION (1) be changed as follows:
Omit the word "Uniform" and replace it with the word "International'.
Omit all references to the word `Bureau" and replace it with "Division ", including in
the title of this section.
Section 3. That Section 8 of Chapter 13, Article 5, DEFINITIONS be changed as
follows:
(1) Omit the word "Uniform" and replace it with the word "International'.
(2) Omit the second definition entirely and replace with the following: "Whenever the
words "Code Official' are used they shall be held to mean "Fire Marshal "'.
Section 4. That Section 8 of Chapter 13, Article 7, ESTABLISHMENT OF
LIMITS OF DISTRICTS IN WHICH THE STORAGE OF FLAMMABLE OR
COMBUSTIBLE LIQUIDS IN OUTSIDE ABOVEGROUND TANKS IS
PROHIBITED be changed as follows:
Omit the reference to section "7902.2.2.1" and replace it with "3404.2.9.5 ".
Omit the word "Uniform" and replace it with the word "International'.
Section 5. That Section 8 of Chapter 13, Article 9, ESTABLISHMENT OF
LIMITS OF DISTRICTS IN WHICH THE STORAGE OF LIQUIFIED PETROLEUM
GASES IS TO BE RESTRICTED be changed as follows:
Omit the reference to section "82.104(a)" and replace it with "3804.1 ".
Omit the word "Uniform" and replace it with the word "International'.
Section 6. That Section 8 of Chapter 13, Article 11, ESTABLISHMENT OF
LIMITS OF DISTRICTS IN WHICH THE STORAGE OF EXPLOSIVES AND
BLASTING AGENTS IS TO BE PROHIBITED be changed as follows:
Omit the reference to section "77.107(a)" and replace it with "3304 and 3306 ".
Omit the word "Uniform" and replace it with the word "International'.
Section 7. That Section 8 of Chapter 13, Article 13, AMENDMENTS TO THE
INTERNATIONAL FIRE CODE be deleted in full and a new Section 8 of Chapter 13,
Article 1 be added as follows:

08- 13 -13: AMENDMENTS MADE IN THE 2000 INTERNATIONAL FIRE CODE:
1) Change 1FC Section 101.1, "Title" to read: These regglations shall be known as
the Fire Code of the City of Caldwell, hereinafter referred to as "this Code ".
2) Change IFC Section 105.1.1 "Permits Re uired" to read: A permit, if re aired
by the local jurisdiction, shall be obtained from the designated official, and any
required fees shall be paid -in -full, prior to engaging in activities requiring a
permit.
3) Add IFC Section 105.6.16.1 "Fireworks Stands ": Fireworks stands. Permits are
required as stipulated in Caldwell Municipal Code Section 8, Chapter 11.
4) Change IFC Section 105.6.31 en Burning" to read: Open burning is
prohibited except as specifically designated as exempt or as allowed with a permit
as stipulated in Caldwell Municipal Code Section 8 Article 17.
5) Change IFC Section 109.3 "Penalties." by deleting eve Lhjng after the Rhrase
"shall be guilty of ' and replace with "an infraction for first -time and minor
offenses. Repeat, intentional serious flagrant or multiple- violations may result in
misdemeanor charges being filed ".
6) Delete all sub - sections of IFC Section 307 "Open Burning" and add a single sub-
section titled "307.1 General." to read: Open burning is prohibited except as
specifically designated as exempt or as allowed with a permit as stipulated in
Caldwell Municipal Code Section 8, Article 17.
7) Add at end of IFC Section 310.2 "Prohibited Areas" " Smoking is prohibited on
construction sites inside of buildings made of or containing combustible materials
and outside within 25 feet of any combustible materials."
8) Add at end of IFC Section 505.1 "Address numbers" add the following sentences:
"All complexes, commercial buildings and industrial facilities shall have address
numerals a minimum of six inches (6 ") tall. Any building located over 100 feet
off the roadway shall have proportionately larger-sized numerals as deemed
ade uate to identify the structure and may be required to post a bi- directional
facing address by the driveway entrance."
9) Omit IFC Section 508.4 "Water SgpRly Tests."
10) Add at end of IFC Section 901.6.1 "Standards." a sentence to read as follows:
The Code Official is authorized to require periodic ins ections and testing of all
required fire protection systems at the time intervals as recommended by the
national standards noted in Table 901.6.1. Such inspections and testing are the
responsibility of the owner or agent of the premises where the protection system
is located.
11) Add the following at the end of IFC Section 901.6.2 "Records. ": The erson or
company performing the inspections shall forward a written report and/or
completed and legible form of the results of such inspection and testing soon
thereafter to the Department of Fire Prevention.
12) IFC Section 903.2.7 "Group R -1" is amended to read as follows: An automatic
sprinkler system shall be provided throughout hotels, motels, and boarding houses
(transient), three (3) or more stories in height, or containing thirteen (13) or more
guest rooms. For the purposes of this requirement, in determining the number of
floors, the word " floors" include those floors that are below surface grade and
those above surface gWe.
13) IFC Section 903.2.8 "Grow R -2" is amended to read as follows: An automatic
sprinkler system shall be provided throughout a artment houses boarding house
not transient convents dormitories fraternities and sororities and monasteries
three (3) or more floors in height including basements or containing six ix (6)
more dwelling units and are more than one story it +fin _height. For the purposes of
this requirement in determining the number of floors, the word "floors" include
those floors that are below surface grade and those above surface grade.
14) IFC Section 903 29 "Group R -4" is amended to read as follows: An automatic
sprinkler system shall be provided throughout residential care /assisted living
facilities more than two 2 floors in height, including basements or where
having more than twenty 20 occupants. For the ppMoses of this requirement, in
determining the number of floors the word "floors" include those floors that are
below surface grade and those above surface grade.
15) Add the following at the end of IFC Section 903.4.2 "Alarms. ": In addition to an
audible notification device for a fire sprinkler water flow alarm, there shall also be
an =roved red - colored visual notification device installed adjacent to the
audible device External audible and visual notification devices ma also
re uired for NFPA 13R and NFPA 13D s rinkler systems.
Section 8. Severability. This ordinance is hereby declared to be severable. Should any
portion of this ordinance be declared invalid by a court of competent jurisdiction, the
remaining provisions shall continue in full force and effect and shall be read to carry out
the purpose(s) of the ordinance before the declaration of partial invalidity.
Section 9. Repeal of Conflicting Provisions. All provisions of the current Caldwell
Municipal Code or Ordinances of the City of Caldwell which conflict with the provisions
of this ordinance are hereby repealed to the extent of such conflict.
Section 10. Effective date. This ordinance shall be effective upon its passage and
publication as provided by law.
