ORDINANCE NO, 2451
AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, A MUNICIPAL CORPORATION, STATE OF IDAHO, BY DELETING
SECTION 1, ARTICLE 1 OF CHAPTER 12 REGARDING ADOPTION OF UNIFORM
BUILDING CODE AND ADDING A NEW SECTION 1, ARTICLE 1 OF CHAPTER
12 REGARDING INTERNATIONAL BUILDING AND RESIDENTIAL CODE, AND
DELETING SECTION 4, ARTICLE 1, CHAPTER 12 REGARDING MODEL
ENERGY CODE; AND DELETING SECTION 21, ARTICLE 1, OF CHAPTER 12
REGARDING AMENDMENTS TO THE UNIFORM BUILDING CODE AND
ADDING A NEW SECTION 21, ARTICLE 1, OF CHAPTER 12 REGARDING
AMENDMENTS TO THE INTERNATIONAL BUILDING CODE AND
INTERNATIONAL RESIDENTIAL CODE; AND DELETING SECTION 1, ARTICLE
13, CHAPTER 12 REGARDING ADOPTION OF UNIFORM MECHANICAL CODE
AND ADDING A NEW SECTION 1, ARTICLE 13, CHAPTER 12 REGARDING
ADOPTION OF INTERNATIONAL MECHANICAL CODE AND INCLUDING
AMENDMENTS TO INTERNATIONAL MECHANICAL CODE: REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Section 1 of Chapter 12, Article 1, ADOPTION OF UNIFORM
BUILDING CODE be deleted in full and a new Section 1 of Chapter 12, Article 1 be
added as follows:
12-01-01: CODE ADOPTION: All the rules, regulations and ordinances of a general
and permanent character relating and applying to and regulating the erection,
construction, enlargement, alteration, repair, moving, removal, conversion, demolition
occupancy, equipment, use height, area of buildings or structures as said rules,
regulations and ordinances are printed and contained in Code Book form designated and
entitled "2000 International Building Code" (IBC) including Chapter 11 of the "2001
Supplement to the International Codes" as published by the International Code Council;
the "2000 International Residential Code" parts I through VI, VIII and IX (IRC) as
published by the International Code Council; "International Energy Conservation Code"
as published by the International Code Council; be and the same hereby ratified and
adopted as the Building Code of Caldwell City and as ratified and adopted shall be the
rules and regulations and ordinances governing the erection, construction, enlargement,
alteration, repair, moving, removal, conversion, demolition, occupancy, equipment,
height, and area of buildings or structures within the City of Caldwell.
Section 2. That Section 4, Article 1, Chapter 12 regarding MODEL ENERGY CODE
be deleted in full.
Section 3. That Section 21 of Chapter 12, Article 1, AMENDMENTS TO THE
UNIFORM BUILDING CODE be deleted in full and a new Section 21 of Chapter 12,
Article 1 be added as follows:
12-01-21: AMENDMENTS TO THE INTERNATIONAL BUILDING CODE,
INTERNATIONAL RESIDENTIAL CODE, AND INTERNATIONAL MECHANICAL
CODE.
1) IBC Section 101.1, "Title" These regulations shall be known as the Building
Code of the City of Caldwell, hereinafter referred to as "this Code".
2) IRC Section 101.1, "Title". These provisions shall be known as the Residential
Code for One — and Two-family Dwellings of the City of Caldwell and shall be
cited as such and will be referred to herein as "this Code".
3) IBC Section 903.2.7 "Group R-1" is amended to read as follows: In hotels and
motels, and boarding houses (transient), 3 or more stories in height, or containing
13 or more guest rooms. For the purposes of this requirement, in determining the
number of floors, the word "floors" include those floors that are below surface
grade and those above surface grade.
4) IBC Section 903.2.8 "Group R-2" is amended to read as follows: An automatic
sprinkler system shall be provided throughout apartment houses, boarding house
(not transient), convents, dormitories, fraternities and sororities and monasteries,
3 or more stories/floors in heights including basements or containing 6 or more
dwelling units and more than 1 story in height. For the purposes of this
requirement, in determining the number of floors, the word "floors" include those
floors that are below surface grade and those above surface grade.
5) IBC Section 903.2.9 "Group R-4" is amended to read as follows: An automatic
sprinkler system shall be provided throughout residential care/assisted living
facilities, more than 2 stories/floors in height, including basements, or where
having more than 20 occupants. For the purposes of this requirement, in
determining the number of floors, the word "floors" include those floors that are
below surface grade and those above surface grade.
6) IBC Section 302.3.3 Exception 2 is amended to read as follows: The private
garage shall be separated from the residence and its attic area by means of
minimum 5/8 inch type X gypsum board applied to garage side. Door openings
between the garage and residence, shall be equipped with either solid wood doors
not less than 13/8 inches thick, solid or honeycomb core steel doors not less than
1 3/8 inches thick or doors in compliance with Section 714.2.3. These doors shall
be provided with a self closing device. Openings from a private garage directly
into a room used for sleeping purposes shall not be permitted.
7) IBC Section 101.4.1, "Electrical" is deleted and repealed in its entirety.
8) IBC Section 101.4.4, "Plumbing" is deleted and repealed in its entirety.
9) IBC Section 101.4.5, is deleted and repealed along with all references to the
International Property Maintenance Code throughout the IBC and IRC.
10)IBC/IRC Section 103.1, "Creation of Building Safety" is amended to read as
follows: The department of building safety is hereby created and the official in
charge thereof shall be known as the Building Official.
11)IBC/IRC Section 103.2, "Appointment" is deleted and repealed in its entirety.
12)IBC Section 105.1.1, "Annual permit" is deleted and repealed in its entirety.
13)IBC Section 105.1.2, "Annual permit records" is deleted and repealed in its
entirely.
14)IBC/IRC Section 105.2, "Subsections on Electrical and Plumbing" are deleted
and repealed in their entirety.
15)IBC/IRC Section 106.5, "Retention of construction documents" is deleted and
repealed in its entirety.
16)IBC Section 108.4 is amended to read as follows: Work commencing before
permit issuance. Any person who commences any work on a building or
structure before obtaining the necessary permit, shall be subject to an
investigation fee in the amount established by the Building Official up to
quadruple of the permit fee. Investigation fees shall be in addition to the required
permit fee.
17)IBC/IRC Section 111.1, "Connection to service utilities" is amended to read as
follows: A final inspection and approval is required upon completion and prior to
occupancy and use of all buildings and structure. Lack of building official
approval may result in the termination of utility services to said building or
structure and prosecution under IBC Section 113.3.
18)IBC Section 115, "Unsafe Structures and Equipment" is deleted and repealed
in its entirety.
19)IBC Section 1608.2 "Ground Snow Loads" is amended to read as follows: The
ground snow load to be used in determining the design snow loads for the City of
Caldwell shall be 20 psf (pg). IBC Section 1612 "Flood Loads" is deleted and
repealed in its entirety.
20)IRC Section R104.10.1 "Areas prone to flooding" is amended to read as
follows: The building official shall not grant modifications to any provisions
related to areas prone to flooding established by Table R301.2(1) with review and
approval by the Caldwell City Floodplain Administrator.
21)IRC Section 105.3.1.1 "Substantially improved or substantially damaged
existing buildings and structure" is amended to read as follows: For
applications for reconstruction, rehabilitation, addition, or other improvement of
existing buildings or structures located in an area prone to flooding as established
by Table R301.2(1), the Caldwell City Floodplain Administrator shall examine or
cause to be examined the construction documents of the proposed work. For
buildings that have sustained damage of any origin, the value of the proposed
work shall include the cost to repair the building or structure to its pre-damage
condition. All substantially improved or reconstruction of existing structures
shall be made in accordance with the Caldwell City Floodplain Ordinance.
22)IRC Section R202 definition for "Townhouse" is amended to read as follows:
TOWNHOUSE is a single family dwelling unit constructed in a row of attached
units separate by property lines and with open space on at least 2 sides.
23)IRC Section R316.2, "Guard Opening Limitations" is amended to read as
follows: Required guards on open sides of stairways, raised floor areas, balconies
and porches shall have intermediate rails or ornamental closures that do not allow
passage of a sphere 4 inches (102 mm) in diameter. Exception: The triangular
opening formed by the riser, tread and bottom rail of a guard at the open side of
the stairway are permitted to be of such a size that a sphere 6 inches (152mm)
cannot pass through.
24)IRC Section R309.2 "Separation Required" is amended to read as follows:
The garage shall be separated from the residence and its attic area by not less than
5/8 inch gypsum board applied to the garage side. Garages beneath habitable
rooms shall be separated from all rooms above by not less than 5/8 inch thick
gypsum board or equivalent, Where the separation is a floor-ceiling assembly, the
structure supporting the separation shall also be protected by not less than 5/8
inch thick board or equivalent. Door openings between the garage and residence
shall be equipped with either solid wood doors not less than 1 3/8 inches thick,
solid or honeycomb core steel doors not less than 1 3/8 inches thick or doors in
compliance with IBC Section 714.2.3. These doors shall be provided with a self-
closing device. Openings from a private garage directly into a room used for
sleeping purposes shall not be permitted.
Exemptions: Agricultural buildings are exempt from the building codes adopted
herein but shall remain subject to placement requirements established by zoning
regulations.
Section 4. That Section 01 of Article 13, Chapter 12 regarding ADOPTION OF
UNIFORM MECHANICAL CODE be deleted and adding a new Section 01, Article 13,
Chapter 12 regarding INTERNATIONAL MECHANICAL CODE as follows:
12-13-01: ADOPTION OF INTERNATIONAL MECHANICAL CODE:
There is hereby adopted for the purpose of establishing rules and regulations for heating,
ventilation and air conditioning in buildings that certain mechanical known as The
International Mechanical Code, 2000 Edition, copies of which are on file in the Office of
the Building Official.
12-13-02 IMC Section 903 "Factory Built Fireplaces" add new section to read as
follows:
Section 903-4 "Provisions for mitigating indoor air pollutants emitted by unvented gas
fireplaces. Unvented gas fireplaces shall not be permitted without the installation of a
supplemental whole-house ventilation strategy, which will serve to provide a non-passive
outside air source to the living space during the time of fireplace operation. Such a
strategy may be provided through the installation of an approved air-to-air heat
exchanger, or an engineered ventilation system designed to mitigate those combustion
by-products emitted by the unvented gas burning appliance.
Section 5. Severability. This ordinance is hereby declared to be severable. Should any
portion of this ordinance be declared invalid by a court of competent jurisdiction, the
remaining provisions shall continue in full force and effect and shall be read to carry out
the purpose(s) of the ordinance before the declaration of partial invalidity.

a. Weathering may require a higher strength concrete or grade of masonry than necessary to
satisfy the structural requirements of this code. The weathering column shall be filled in
with the weathering index (i.e., "negligible," "moderate", or "severe") for concrete as
determined from the Weathering Probability Map [Figure R301.2(3)]. The grade of
masonry units shall be determined from ASTM C34, C55, C62, C73, C90, C129, C145,
C216 or C652.
b. The frost line depth may require deeper footings than indicated in Figure R403.1(1). The
jurisdiction shall fill in the frost line depth column with the minimum depth of footing
below finish grade.
c. The jurisdiction shall fill in this part of the table with`very heavy", "moderate to heavy,"
"slight to moderate," or "none to slight" in accordlnce with Figure R301.2(6) depending
on whether there has been a history of local damage.
d. The jurisdiction shall fill in this part of the tale with "moderate to severe," "slight to
moderate," or"none to slight"in accordance with R301.2(7) depending on whether there
has been a history of local damage.
e. The jurisdiction shall fill in this part of the table with the wind speed from the basic wind
speed map [Figure R301.2(4)]. Wind exposure category shall be determined on a site-
specific basis in accordance with Section R301.2.1.
f. The outdoor design dry bulb temperature shall be selected from the columns of 97 %z
percent values for winter from ASHRAE-97 Handbook of Fundamentals.
g. The jurisdiction shall fill in this part of the table with the Seismic Design Category
determined from Section R301.2.2.1.
The jurisdiction shall fill in this part of the table with(a)the date of the jurisdiction's
entry into the National Flood Insurance Program(date of adoption of the first code or
ordinance for management of flood hazard areas),(b)the date(s) of the currently
effective FIRM and FBFM, or other flood hazard map adopted by the community, as

Section 6. Repeal of Conflicting Provisions. All provisions of the current Caldwell
Municipal Code or Ordinances of the City of Caldwell which conflict with the provisions
of this ordinance are hereby repealed to the extent of such conflict.
Section 7. Effective date. This ordinance shall be effective upon its passage and
publication as provided by law.
