AN ORDINANCE TO PROVIDE A C -2 (COMMUNITY COMMERCIAL) ZONE DESIGNATION FOR CERTAIN
LANDS; DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,
IDAHO; INSTRUCTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO
DESIGNATE SAID PROPERTY AS C -2 ON THE OFFICIAL ZONING MAP AND OTHER AREA MAPS OF
THE CITY REPEALING ALL LAWS ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation of the
Caldwell Planning and Zoning Commission that Case No. ZON- 24 -02, a request by Intermountain Community
Bank L.L.0 to rezone certain property, and following the public notice and hearing procedures as required by
Idaho Code, Chapter 65 Local Planning Act, that the following described property be zoned C -2 (Community
Commercial) zone and that said zoning designation is in the best interest of the City of Caldwell, Idaho.
Section 1. The property is located southwest of the intersection of Ninth Avenue and Dearborn Street and
northeast of the alley between 9th Avenue and 10 Avenue abutting Dearborn Street. The parcel is inside the
corporate boundaries of the City of Caldwell, and the Applicant has requested this lot to be rezoned as C -2
(Community Commercial) zone:
A parcel of land that is all that part of Block 102 as appears according to the revised map of Caldwell, filed in
Book 1 of Plats, page 20, records of Canyon County and located in the SW % of the SW ' / 4 of Section 22, and
the NW % of the NW % of Section 27, T4N, R3W, of the Boise Meridian, more particularly described as follows:
TX 14A - All of that part of Block 102 as appears according to the revised map of Caldwell, Canyon County,
Idaho, filed in Book 1 of Plats, page 20, of the records of Canyon County, Idaho; and of the NW % of the NW
of Section 27, Twp. 4 N., R. 3 W.B.M., particularly described as follows:
COMMENCING at the Northerly corner of aforesaid Block 102 and running thence Southwesterly along the
Northwesterly boundary line of said Block 102 (being along the Southeasterly boundary line of 9 th Avenue of
City of Caldwell, Idaho) a distance of 80 feet to the REAL POINT OF BEGINNING;
Thence running Southwesterly along the same straight line a distance of 40 feet to a point in the Northeasterly
boundary line of the alley; Thence running in a Southeasterly direction along the alley line (being along a line
parallel with the Northeasterly boundary line of said Block 102), a distance of 75 feet; Thence running
Northeasterly on a line parallel with the Southeasterly boundary line of said 9'" Avenue, a distance of 40 feet;
Thence running Northwesterly a distance of 75 feet to the REAL POINT OF BEGINNING.
TX 14 - Beginning at the Northerly corner of Block 102 as appears by the Revised Map of Caldwell, Canyon
County, Idaho, filed July 29, 1891 at 3:00 o'clock P.M. and now of record in Book 1 of Plats, page 20, records of
Canyon County, Idaho;
Thence Southeasterly along the Northeasterly line of said Block a distance of 75 feet; Thence Southwesterly
parallel with the Northwesterly line of said Block 80 feet; Thence Northwesterly parallel with the Northeasterly
line of said Block 75 feet to the Southeasterly line of 9 1h Avenue (formerly know as First Avenue East) of said
City of Caldwell; Thence Northeasterly along said Southeasterly line 80 feet to the place of beginning;
TX 15 - Beginning at a point on the Southwest line of Dearborn Street (formerly 4 th Street South), said point
being 75 feet in a Southeasterly direction from the North corner of Block 102, as designated by the REVISED
MAP OF CALDWELL IDAHO, filed July 29, 1891 and now of record in Book 1 of Plats, page 20, records of
Canyon County, Idaho; thence in a southeasterly direction 75 feet along said Southwest line of Dearborn Street;
thence in a Southwesterly direction 120 feet parallel with 9 th Avenue (formerly First Avenue East); thence in a
Northwesterly direction 75 feet parallel with said Southwest line of Dearborn Street; thence in a Northeasterly
direction 120 feet parallel with said 9 th Avenue to the point of beginning;
TX 17 - All of that part of Block 102 according to the REVISED MAP OF CALDWELL IDAHO, filed July 29, 1891
and now of record in Book 1 of Plats, page 20, records of Canyon County, Idaho, and the Northwest Quarter of
the Boise Meridian, Canyon County, Idaho; BEGINNING at a point on the Southwest line of Dearborn Street
(formerly Fourth Street South), said point being 225 feet in a Southeasterly direction from the Northerly corner of
