AN ORDINANCE TO PROVIDE A R -3 (MULTIFAMILY HIGH DENSITY) ZONE DESIGNATION FOR CERTAIN
LANDS; DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,
IDAHO; INSTRUCTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO
DESIGNATE SAID PROPERTY AS R -3 ON THE OFFICIAL ZONING MAP AND OTHER AREA MAPS OF
THE CITY REPEALING ALL LAWS ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation of the
Caldwell Hearing Examiner that Case No. ZON -13 -01 a request by Karen Roark to rezone certain property, and
following the public notice and hearing procedures as required by Idaho Code, Chapter 65 Local Planning Act,
that the following described property be zoned R -3 (Multi - Family High Density Residential) and that said zoning
designation is in the best interest of the City of Caldwell, Idaho.
Section 1. The property fronts on Logan Street approximately 458 feet northeast of the intersection of
Dorman Avenue and W. Logan Street. The parcel is inside the corporate boundaries of the City of Caldwell,
and the Applicant has requested this parcel to be rezoned as an R -3 (Multi - Family High Density Residential)
zone:
Section 28, Range 4 North 3, Pioneer Subdivision Block 44, South of Parker Drain less East 930 ", Block 45
South of Parker Drive less Hillview Place, Block 3 less tax 1 and less tax 2, records of Canyon County
Recorders Office.
Tax 1 - This parcel is situated in the SE114 NWIA of Section 28, Township 4 North, Range 3 West of the Boise
Meridian and is more particularly described as follows:
COMMENCING at the Southwest corner of said SE114 NW114; Thence South 89 0 55'00" East, along the South
boundary of said SE 1 /4 NW % a distance of 130.24 feet to the TRUE POINT OF BEGINNING. Thence North
0 0 15'00" West, a distance of 180.00 feet; Thence South 89 0 55'00" East, parallel with the South boundary of said
SW %, NW '/4, a distance of 130.00 feet; Thence South 0 °15'00" East, a distance of 180.00 feet to a point on th
eSouth boundary of said SW % NW %; Thence North 89 °55'00" West, along the South boundary of said SW114
NW Y4, a distance of 130.00 feet to the TRUE POINT OF BEGINNING.
Tax 2 - This parcel is a portion of the SE ' / 4 NW % of Section 28 Township 4 North, Range 3 West, of the Boise
Meridian and is more particularly described as follows:
COMMENCING at the southwest corner of said SE114 NW 114; Thence South 89 26' 02" East (of Record S.
89 °55' 00" E.) along the south boundary of said SE' /4 NW' /4 a distance of 260.24 feet to the TRUE POINT OF
BEGINNING; Thence North 0 33' 58" East (of Record N. 0 15' 00" W.) a distance of 180.00 feet; Thence
South 89° 26'02" East parallel with said south boundary a distance of 100.73 feet to a point which lies on a line
30.00 feet westerly from and parallel with the west boundary of the parcel described in and recorded as Inst. No.
9212724, Records of Canyon County, Idaho; Thence South 0° 03' 19" West along said parallel line a distance of
180.01 feet to a point on said south boundary; Thence North 89 26' 02" West along said south boundary a
distance of 112.34 feet to the TRUE POINT OF BEGINNING.
Section 2. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other area
maps of the City of Caldwell, Idaho as an R -3 (Multi - Family High Density Residential) zone.
Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 4. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
