That by a motion passed by the Council and approved by the Mayor of the City of Caldwell, Idaho, and statutory notice having been given to the citizens and owners of property in the City of Caldwell, Idaho, in accordance with Section 50- 1306A, Idaho Code, that an application has been presented to the Mayor and Council of the City of Caldwell, Idaho, requesting passage and approval of an ordinance vacating the above described real property located in Caldwell, Canyon County, Idaho. Section 2. That a Public Hearing was held on December 3, 2001, by the City Council and no objection to said vacation was heard, or that objections were heard, fully considered and passed by said Council. Section 3. That said right -of -way does not contain public or private utility lines that cannot feasibly be relocated or retained through the establishment of appropriate easements, which are to be created and recorded by separate instruments. Section 4. That it is hereby determined it is in the best interest of the public that the above - described premises in the City of Caldwell, Canyon County, Idaho be vacated, subject to the following terms and conditions: A. That until a portion of the Fillmore Drain in Illinois Avenue and Ash Street, owned by the City of Caldwell, Idaho, is relocated to a location in other public rights -of -way and/or easements acceptable to the City Engineer, the City of Caldwell shall retain easement rights for maintenance and operation of the _r o C) O BILL NO. 39 CD r - ORDINANCE NO. 2403 c trn s Fri AN ORDINANCE RECITING PETITION FOR VACATION CND RECITING APPROPRIATE NOTICE WAS GIVEN; DETERMINING THAT VACATION OF SAID PUBLIC RIGHT -OF -WAY IN THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, DESCRIBED BELOW, SHALL BE MADE; AND DETERMINING THAT VACATION OF SAID FOLLOWING PROPERTY IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, CANYON COUNTY, IDAHO. P This vacation is for portions of Illinois Avenue (from Ash to 132 feet south), Iowa Avenue (from e4 Oak to Ash ), Ash Street (from 78 feet west of Iowa to 108 feet east of Illinois), and the alley that ` -"c runs from Illinois to Iowa, parallel with and between Ash and Oak Streets. The request is made 5N to facilitate construction of new student housing for Albertson College of Idaho. Said easement rights shall have widths equal to the platted rights -of -way for these portions of Illinois Avenue and Ash Street. B. That prior to the recordation of the vacation, the applicant shall perform the following subject to the review and approval of the City Engineer (item no.'s 4 through 7 may be deferred up to one year from recordation, provided a financial guarantee is posted with the City at 110% of the cost for the work, subject to approval of the City Engineer): Provide the City utility easements to protect existing public utilities and their necessary appurtenances located within the public rights -of -way being vacated. 2. Provide a 20' x 60' concrete or asphalt pad for off -street parking for the residence at 1716 E. Ash Street, Caldwell. 3. Install signs that restrict parking within public rights -of -way adjacent to Mr. Keesee's property, located at 1718 E. Ash Street, Caldwell, to reserve parking for Mr. Keesee and his successors and assigns unless said successor and assign is Albertson College of Idaho, in which case said parking restriction shall terminate. 4. Relocate a portion of the Fillmore Drain owned by the City of Caldwell, Idaho to a location in other public rights- of-way and /or easements acceptable to the Caldwell City Engineer. 5. Provide street signage and striping acceptable to the Caldwell City Engineer to address transportation and parking issues within the area. 6. Construct two permanent turn- arounds (protected by easements or rights - of -way) meeting Fire Department Standards on Ash; one west of Iowa and one east of Illinois. 7. Widen Oak Street (from College to Wisconsin) to a minimum width of 37' to 41' back of curb to curb and install a 4' wide sidewalk along properties owned by the College. Also, widen the south side of Oak Street (from Wisconsin to Indiana) so that the back of curb is a minimum of 18.5' to 20.5' from street centerline and construct 4' sidewalk along properties owned by the college. This will require additional rights -of -way along college owned properties.
