AN ORDINANCE TO PROVIDE A C-2 (COMMUNITY COMMERCIAL) ZONE DESIGNATION FOR CERTAIN
LANDS; DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,
IDAHO; INSTRUCTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO
DESIGNATE SAID PROPERTY AS C -2 ON THE OFFICIAL ZONING MAP AND OTHER AREA MAPS OF
THE CITY REPEALING ALL LAWS ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation of the
Caldwell Planning and Zoning Commission that Case No. ZON-- 17 -01, a request by Hawkins Companies LLC to
rezone certain property, and following the public notice and hearing procedures as required by Idaho Code,
Chapter 65 Local Planning Act, that the following described property be zoned C -2 (Community Commercial)
zone and that said zoning designation is in the best interest of the City of Caldwell, Idaho.
Section 1. The property is Lots 12 -20 Block 26, Dorman's Addition, more commonly known as 1009, 1017,
1019 and 1021 Dearborn Street and 416 S-1 1' Avenue. The parcels are inside the corporate boundaries of the
City of Caldwell, and the Applicant has requested these lots to be rezoned as C -2 (Community Commercial)
zone:
Lots 18, 19 and 20, Block 26, DORMAN'S ADDITION to Caldwell, Canyon County, Idaho, according to the plat
filed in Book 1 of Plats, Page 19 records of said county.
Lots 16 and 17, Block 26, DORMANS ADDITION to Caldwell, Canyon County, Idaho, according to the plat filed
in Book 1, Page 19 records of said County.
All of Lots 12, 13, 14 and 15 in Block 26 of DORMAN'S ADDITION to Caldwell, Idaho according to the Plat of
said Addition filed July 22, 1891, in Book 1 of Plats at Page 19, in the Office of the County Recorder, Canyon
County, Idaho. EXCEPTING THEREFROM: All that part of Lots 12, 13, and 14 in Block 26 at DORMAN'S
ADDITION to Caldwell, Idaho, as appears by the Official Plat of said Addition on file and of record in the Office
of the County Recorder of Canyon County, Idaho, described as follows: BEGINNING at the Easterly corner of
Lot 12 in said Block 26 and running thence Southwesterly along the Southeasterly fine of said Lot 12, a distance
of 55 feet; thence running in a Northwesterly direction on a line parallel with the Southwesterly boundary line of
said Block 26, a distance of 65 feet; thence running in a Northeasterly direction on a line parallel with the
Southeasterly boundary line of said Block 26, a distance of 55 feet to a point in the Northeasterly boundary line
of said Lot 14; thence running in a Southeasterly direction along the Northeasterly boundary line of said Lots 14,
13, 12, a distance of 65 feet to a POINT OF THE BEGINNING.
AND ALSO EXCEPTING THEREFROM: COMMENCING at the South corner of Block 26, DORMAN'S
ADDITION to Caldwell, Idaho, according to the plat of said Addition filed July 22, 1891 in Book 1 of Plats at
Page 19, in the Office of the County Recorder, Canyon County, Idaho; thence Northwesterly along the
Southwesterly boundary line of said Block 26, 68 feet; thence Northeasterly and parallel with the Southwesterly
boundary line of said Block 26, 65 feet; thence Southeasterly and parallel with the Southeasterly boundary line
of said Block 26, 68 feet to the Southeasterly boundary of said Block 26; thence Southwesterly along the
Southeasterly boundary line of said Block 26, 65 feet to THE POINT OF BEGINNING.
COMMENCING at the South corner of Block 26, DORMAN'S ADDITION to Caldwell, Idaho, according to the
plat of said Addition filed July 22, 1891 in Book 1 of Plats at Page 19, in the Office of the County Recorder,
Canyon County, Idaho; thence Northwesterly along the Southwesterly boundary line of said Block 26, 68 feet;
thence Northeasterly and parallel with the Southwesterly boundary line of said Block 26, 65 feet; thence
Southeasterly and parallel with the Southeasterly boundary line of said Block 26, 68 feet to the Southeasterly
boundary of said Block 26; thence Southwesterly along the Southeasterly boundary line of said Block 26, 65 feet
to THE POINT OF BEGINNING.
