ORDINANCE NO. 2399
AN ORDINANCE TO PROVIDE A C -1 (NEIGHBORHOOD COMMERCIAL) AND R -2 (MEDIUM DENSITY
RESIDENTIAL) ZONE DESIGNATION FOR CERTAIN LANDS; DETERMINING THAT SAID ZONING IS IN
THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE CITY ENGINEER AND
COMMUNITY DEVELOPMENT DIRECTOR TO DESIGNATE SAID PROPERTY AS C -1 AND R -2 ON THE
OFFICIAL ZONING MAP AND OTHER AREA MAPS OF THE CITY REPEALING ALL LAWS ORDINANCES
AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell upon recommendation of the
Caldwell Planning and Zoning Commission that Case No. ZON- 16 -01, a request by Willis and Sharon Hubler to
rezone certain property, and following the public notice and hearing procedures as required by Idaho Code,
Chapter 65 Local Planning Act, that the following described property be zoned C -1 (Neighborhood Commercial)
and R -2 (Medium Density Residential) respectively and that said zoning designation is in the best interest of the
City of Caldwell, Idaho.
Section 1. The property is generally located at the southeast corner of the intersection of Kimball Avenue and
Linden Street. The parcels are inside the corporate boundaries of the City of Caldwell, and the Applicant has
requested these lots to be rezoned as C -1 (Neighborhood Commercial) and R -2 (Medium Density Residential)
respectively:
Parcel 1 - C -1 Zone - This parcel is a portion of the NE '/4 NE ' / A of Section 33, Township 4 North, Range 3
West of the Boise Meridian and is more particularly described as follows: BEGINNING at the northwest corner
of said NE % NE %; thence North 89 59' 40" East along the north boundary of said NE % NE' /, a distance of
330.00 feet; thence South 0° 03' 04" East parallel with said west boundary a distance of 264.00 feet to a point
on the north boundary of the CINDERELLA PARK ADDITION (Book 7, Page 29); thence South 89° 59' 40" West
along said north boundary a distance of 177.45 feet; thence North 0 03' 04" West parallel with said west
boundary a distance of 142.90 feet; thence South 89 59'40" West parallel with said north boundary a distance
of 152.55 feet to a point on said west boundary; thence North 0 03' 04" West along said west boundary a
distance of 121.10 feet to the POINT OF BEGINNING. This parcel contains approximately 1.5 acres more or
less.
Parcel 2 — R -2 Zone — That part of the Northwest Quarter of the Northeast Quarter of the Northeast Quarter of
Section 33, Township 4, North, Range 3 West of the Boise Meridian, in Canyon County, Idaho, described as
follows, to wit:
Beginning at a point 110 feet West of the Northeast corner of the Northwest Quarter of the Northeast Quarter of
the Northeast Quarter of said Section 33; thence running West along the North line of said Northeast Quarter, a
distance of 220 feet; thence running South at right angles a distance of 264 feet; thence East at right angles a
distance of 220 feet; thence running North at right angles a distance of 264 feet to the point of beginning.
EXCEPTING there from an easement consisting of a strip of land ten feet in width commencing at the Northeast
corner of said premises and running approximately 140 feet South along the East line of said premises.
Section 2. That the City Engineer and the Community Development Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other area
maps of the City of Caldwell, Idaho as an R -3 (Multi - Family High Density Residential) zone.
Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 4. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 7 th day of January 2002.
