ORDINANCE NO. 2375
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT
APPROXIMATELY 16.44 PORTION OF SAID LANDS SHOULD BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART THE C -2 (COMMUNITY COMMERCIAL) ZONE DISTRICT AND
APPROXIMATELY 60.02 AS THE R -1 (SINGLE - FAMILY RESIDENTIAL) ZONE DISTRICT; AND
DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A
PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CITY ENGINEER AND COMMUNITY DEVELOPMENT DIRECTOR TO ADD
SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF
IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION
63 -2219.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Planning and Zoning Commission, and
following the public notice and hearing procedures set forth in Section 10- 01 -07, Zoning Ordinance No. 1451,
approved Case No. ANN -50 -01 (Tarrant Family) on May 21, 2001.
Section 2. The property is located at the southwest comer of the intersection of Ustick Road and South 10'
Avenue. The parcels are contiguous to the City of Caldwell, Idaho and the applicants have requested that said
following described property should be annexed to the City of Caldwell as a C -2 zone, and an R -1 zone, as set
forth in the legal descriptions.
Parcel 1- R -1 Zone: This parcel is a portion of Government Lot 1 and of the SE 3 /4 NE V4 of Section 4,
Township 3 North Range 3 West of the Boise Meridian and is more particularly described as follows:
COMMENCING at the northeast comer of said Government Lot 1; Thence South 0 °04'28" East along the east
boundary of said Government Lot 1 a distance of 660.00 feet to the TRUE POINT OF BEGINNING; Thence
continuing South 0 1 04'28" East along said east boundary a distance of 740.34 feet to the northeast comer of said
SE %4 NE %a; Thence South 0 °04'28" East along the East boundary of said SE '/a NE '/4 a distance of 1327.33 feet
to the southeast comer of said SE %4 NE ' / 4; Thence South 89 °23'01" West along the south boundary of said SE
' /4 NE %4 a distance of 773.95 feet to a point in the centerline of the Phillis Canal; Thence North 33 0 54'07" West
along said centerline a distance of 203.86 feet; Thence North 34°31'30" West continuing along said centerline a
distance of 784.49 feet to a point on the west boundary of said SE ' / 4 NE %4; Thence North 0 °06'07" West along
said west boundary a distance of 505.01 feet to the southwest comer of said Government Lot 1; Thence North
0 0 06'07" West along the west boundary of said Government Lot 1 a distance of 1414.51 feet to the northwest
comer of said Government Lot 1; Thence North 89 1 57'29" East along the north boundary of said Government
Lot 1 a distance of 30.00 feet; Thence South 0 °06'07" East Parallel with the said west boundary a distance of
370.00 feet; Thence North 89 °57'33" East parallel with said north boundary a distance of 217.00 feet; Thence
South 0 1 06'07" East parallel with said west boundary a distance of 290.00 feet; Thence North 89 °57'33" East
parallel with said north boundary a distance of 1084.79 feet to the TRUE POINT OF BEGINNING. This
parcel contains 60.02 acres, more or less, and is subject to a public road right-of-way along the east boundary
and to all other easements or rights -of -way of record or implied.
Parcel 2 — C -2 Zone: This parcel is a portion of Government Lot I of Section 4, Township 3 North Range 3
West of the Boise Meridian and is more particularly described as follows: BEGINNING at the northeast comer
