ORDINANCE NO. 2357
AN ORDINANCE TO PROVIDE A C-2 (COMMUNITY COMMERCIAL) ZONE DESIGNATION AND
AN R-1 (SINGLE-FAMILY RESIDENTIAL) ZONE DESIGNATION FOR CERTAIN LANDS;
DETERMINING THAT SAID ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,
IDAHO; INSTRUCTING THE COMMUNITY DEVELOPMENT DIRECTOR AND CITY ENGINEER TO
DESIGNATE SAID PROPERTY AS A C-2 ZONE AND R-1 ZONE RESPECTIVELY ON THE OFFICIAL
ZONING MAP AND OTHER AREA MAPS OF THE CITY; REPEALING ALL LAWS, ORDINANCES
AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY
OF CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the recommendation
of the Caldwell Hearing Examiner that Case No. ZON-11-00, a request by Crestline Development, LC and
Heartland Development, LLC to rezone certain property, and following the public hearing procedures as required
by Idaho Code, Chapter 65, Local Planning Act, that the following described property be zoned C-2 (Community
Commercial) and R-1 (Single -Family Residential) respectively and that said zoning designations are in the best
interest of the City of Caldwell, Idaho.
Section 1. The parcels are located in the southeast corner of the intersection of KCID Road and Highway 20/26 and
runs eastward parallel with Highway 20/26 a short distance. The parcels within the City of Caldwell and the
applicants have requested that they be rezoned as C-2 and R-1 respectively and said parcels are legally described as
follows:
R-1 parcel: A portion of the NW %4 of Section 30, Township 4 North, Range 2 West, Boise Meridian, Caldwell,
Canyon County Idaho, more particularly described as follows: Commencing at the NW corner of said NW '/4,
(Section corner common to sections 24, 19, 30 and 25), said comer monumented with a 3 inch diameter brass disc;
Thence S. 0'37'12" W., a distance of 538.02 feet along the westerly boundary of said NW '/4 to the POINT OF
BEGINNING, said point monumented with a 5/8 inch diameter iron pin; Thence continuing S. 0'37'12" W., a
distance of 89.86 feet along the westerly boundary of said NW %4 to a point; Thence S. 89°50'21" E., a distance of
753.79 feet parallel with the northerly boundary of said NW '/4 to a point; Thence N. 0'37'12" E., a distance of
332.87 feet parallel with the westerly boundary of said NW %4 to a point; Thence N. 89°50'21" W., a distance of
0.77 feet parallel with the northerly boundary of said NW '/4 to a point; Thence S. 0'37'12" W., a distance of 243.01
feet parallel with the westerly boundary of said NW %4 to a point; Thence N. 89°50'21" W., a distance of 753.02
feet parallel with the northerly boundary of said NW %4 to the POINT OF BEGINNING, containing 1.559 acres
more or less.
C-2 parcel: A portion of the NE '/4 NW '/4 and a portion of Government Lot 1 of Section 30, Township 4 North,
Range 2 West, Boise Meridian, Caldwell, Canyon County Idaho, more particularly described as follows:
Commencing at the NW comer of said Government Lot 1, (Section corner common to sections 24, 19, 30, and 25),
said corner monumented with a 3 inch diameter brass disk; Thence S. 0'37'12" W., a distance of 50.00 feet along
the westerly boundary of said Government Lot 1 to a point on the Southerly right of way of U.S. Highway 20-26,
(Franklin Road); Thence S. 89°50'21" E., a distance of 753.02 feet along the southerly right of way of said U.S.
Highway 20-26 and parallel with the northerly boundary of said NW %4 to the POINT OF BEGINNING; Thence
continuing S. 89°50'21" E., a distance of 1841.62 feet parallel with the northerly boundary of said NW'/4 to a point
on the easterly boundary of said NE'/4 NW '/4; Thence S. 0°22'27" W., a distance of 245.01 feet along the easterly
boundary of said NE %4 NW %4 to a point; Thence N. 89°50'21" W., a distance of 1842.67 feet parallel with the
northerly boundary of said NW %4 to a point; Thence N. 0'37'12" E., a distance of 245.01 feet parallel with the
westerly boundary of said Government Lot 1 to the POINT OF BEGINNING, containing 10.361 acres more or less.
Section 2. The Community Development Director and City Engineer of the City of Caldwell, Idaho, are hereby
instructed to so designate the same above described property on the official zoning map and other area maps of the
City of Caldwell, Idaho as C-2 (Community Commercial) and R-1 (Single -Family Residential) respectively.
Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 5. This Ordinance shall be in full force and in effect from and after its passage, approval and publication,
according to law.

REGARDING REZONING OF CERTAIN PROPERTY
This ordinance provides for the rezoning of certain property from R-1 (Single-Family Residential) to C-2
(Community Commercial) and from C-2 to R-1 respectively in the City of Caldwell. Said parcels are

Lot 1 to the POINT OF BEGINNING, containing 10.361 acres more or less. The Ordinance includes a
provision to amend the official zoning map and other area maps of the City by designating the above-
described property as C-1, and provides an effective date, which shall be when published in the Idaho Press
Tribune on the 13th day of Nov. ' 2000. Ordinance No. 2357 was passed by the Council on the
6t y of I OV 2000 and the full text of the Ordinance is available at Caldwell City Hall, 621
Cleveland Boulevard, Caldwell, Idaho. The Mayor and City Council approved the foregoing summary for
publication pursuant to Idaho Code 50-901A this 6 t day of Nov ,2000.
