BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the recommendation of the Caldwell Hearing Examiner that Case No. ZON-09-00, a request by Anthony Elordi and Jacksons Food Store to rezone certain property, and following the public hearing procedures as required by Idaho Code, Chapter 65, Local Planning Act, that the following described property be zoned C-1 (Neighborhood Commercial) and that said zoning designation is in the best interest of the City of Caldwell, Idaho. Section 1. The site is located at the northeast comer of the intersection of E. Logan Avenue and Kimball Avenue and is legally described as Parcel 1 — BEGINNING at a point on the West boundary line of Lot 1, Fair Acres, Caldwell, Idaho, in Sections 27 and 28, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho, according to the plat filed August 28, 1903 in Book Iof Plats, Page 33, records of said County, which point of beginning is 92 feet North of the Southwest corner of said Lot 1; thence running North along the West boundary line of said Lot 1 a distance of 58 feet; thence East parallel with the South boundary of said Lot 1 a distance of 132.5 feet; thence South parallel with the West boundary line of said Lot 1, 58 feet; thence running West 132.5 feet to the PLACE OF BEGINNING. Parcel 2 —BEGINNING at the Southwest corner of Lot 1 (sometimes designated as Block 1), Fair Acres, Caldwell, Canyon County, Idaho, according to the plat filed in Book 1 of Plats, Page 33, records of said County; thence running North along the West boundary line of said Lot 1 a distance of 92 feet; thence running East along a line parallel with the South boundary line of said Lot 1 a distance 132.5 feet to the REAL POINT OF BEGINNING; continue thence East along the same straight line a distance of 16 feet; thence running North on a line parallel with the West boundary line of said Lot 1 a distance of 158 feet; thence West 16 feet; thence South 158 feet to the REAL POINT OF BEGINNING. Section 2. The Community Development Director and City Engineer of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as C-1 (Neighborhood Commercial). Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This Ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Said property is located at the northeast corner of the intersection of E. The Ordinance includes a provision to amend the official zoning map and other area maps of the City by designating the above-described property as C-1, and provides an effective date, which shall be when published in the Idaho Press Tribune on the 23rdday of October , 2000. Ordinance No. 2356 was passed by the Council on the 16th day of October, 2000 and the full text of the Ordinance is available at Caldwell City Hall, 621 Cleveland Boulevard, Caldwell, Idaho. The Mayor and City Council approved the foregoing summary for publication pursuant to Idaho Code 50-901A this 16th day of October,2000.
