ORDINANCE NO. 2299
AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, STATE OF IDAHO, BY DELETING AND ADDING CERTAIN
LANGUAGE IN CHAPTER 6, ARTICLE 7, SECTION 35, (1),(2), AND (3)
PERTAINING TO LIQUOR CATERING PERMIT: REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDER OR PARTS THEREOF IN CONFLICT
HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Section 35, (1), (2), and (3) of Chapter 6, Article 7 be amended as
follows:
06- 07 -35: LIQUOR, WINE AND BE CATERING PERMIT:
(1) Any person holding a City of Caldwell liquor, beer, or wine license may serve and
sell liquor, beer or wine retail by the drink at a party or convention, but said
license shall not exceed three (3) consecutive days upon obtaining a liquor
catering permit. In addition alternating permits shall not be issued to ol2erate
what would be a six day per week bar without a_ license. Applications for such
permit shall be made to the City Clerk upon the form prescribed by the Direeter
of Law Enfememem for- the State of ld Chief of Police, which shall contain
the following information:
A. The name and address of the applicant and the number of the applicant's State
Liquor, Beer or Wine license and the applicant's County and City liquor, beer, or
wine license number An alcohol beverage catering ermit shall be limited to
authorization to sell liquor or beer or wine, or any combination thereof, based
upon the jyjae of license which the a licant possesses.
B. The dates and hours during which the permit is to be effective, not to exceed
three (3) consecutive days.
C. The names of the organizations, groups, or persons sponsoring the event.
D. The address at which the liquor, beer or wine is to be served.
(2) The application shall be verified by the applicant and filed with the City Clerk. A
filing fee in the amount of twenty dollars ($20.00) for each day the permit is to be
0 a
effective shall be paid to the City Treasurer and Finance Director which shall not
be refunded in any event.
(3) Upon filing of an application, the City Clerk shall, upon the advice and
recommendation of the Chief of Police, approve or disapprove the application and
indicate the determination on the face of the application by endorsement signed
by the Clerk of the City. Copies of the application's signed endorsements thereon
shall be mailed or delivered immediately to the Chief of Police, the Dire eter -of
and the applicant and a
signed copy retained by the Clerk.
Section 2. All ordinances or parts of ordinances inconsistent herewith are hereby
repealed.
Section 3. This ordinance shall be in full force and effect from and after its
passage, approval, and publication according to law.
