ORDINANCE NO. 2283
AN ORDINANCE TO AMEND CHAPTER 10, OF THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, REGARDING: AMENDMENTS TO
ARTICLE 2, SECTION 10- 01 -01, GENERAL REGULATIONS BY DECLARING ONE USE PER
LOT UNLESS OTHERWISE PERMITTED; SECTION 10- 02 -02, TABLE 1, LAND USE SCHEDULE
BY REPEALING "AUTO SALES, MINOR REPAIR, STORAGE, RENTAL" AND BY ADDING
"AUTOMOTIVE SALES -NEW, AUTOMOTIVE SALES -USED, AUTOMOTIVE RENTAL,
AUTOMOTIVE REPAIR, AUTOMOTIVE STORAGE, MINI STORAGE" TO THE LIST OF USES
IN CERTAIN DISTRICTS; ADDING "PARKING LOT, GARAGE OR FACILITY" AS A SPECIAL
USE IN AN R -3 ZONE; ARTICLE 3, SECTION 10- 03 -11, DEFINITIONS, BY REPEALING
"AUTOMOBILE SALES LOT" AND BY ADDING DEFINITIONS FOR "AUTOMOTIVE SALES -
NEW, AUTOMOTIVE SALES -USED, AUTOMOTIVE RENTAL, AUTOMOTIVE REPAIRS."
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS, AND PARTS THEREOF IN
CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho:
Section 1. That Article 2, Section 10- 02 -01, General Regulations shall be amended by adding certain
language as follows:
GENERAL REGULATIONS: Land and premises shall be used unless otherwise provided in this Title or in
conformity with regulations herein set forth for the zoning districts in which said land or premises is located.
The following zoning district regulations shall apply to all zoning districts established in this Chapter: the Land
Use Schedule (Section 10- 02 -02), Height, Setback, and Area Schedule (Section 10- 02 -03), Oil=- Street Parking,
Loading Schedule (Section 10- 02 -05) and Sign Schedule (Section 10- 02 -06) are a part of this Chapter. Only
one of the uses as set forth in Table 1 Land Use Schedule shall be permitted on a lot or parcel unless
otherwise allowed under Section 10 -02 -08 Nonconforming Uses, Subsection 11, or Section 10- 03-07,
Planned Unit Developments.
Section 2. That Article 2, Section 10 -02 -02, Land Use Schedule, shall be amended by deleting
certain language and adding certain language as follows:

Section 3. That Article 3, Section 10- 03 -11, Definitions, shall be amended by deleting certain language
and by adding certain language as follows:
AUTOMOTIVE SALES - NEW: A lot or parcel used be an _authorized dealership that is urimarily in the
business of selling new vehicles such as cars, trucks, sport utilities, motor homes, recreational vehicles or
motorcycles. A buildm-a housing, a show room, sales room, offices, and repair /service area may be included
as a part of the dea lership. The dealership may also sell used vehicles and provide rental and/or ieasina
services.
AUTOMOTIVE SALES -- USED: A lot or parcel used for the sale of used vehicles such as cars trucks, sport
utilities motor homes recreational vehicles or motors cles. All vehicles held for sale shall be in operatin
condition and no automotive repair or service work shall be permitted on the lot or,parcel.
AUTOMOTIVE RENTAL - A lot or parcel used for the rental of vehicles such as cars, trucks sport utilities
motor homes, recreational vehicles or motorcycles. A building housing offices May be included as a part of
the business; however, all vehicles held for rental shall be in operating condition and no automotive repair or
service work shall be permitted on the lot or parcel.
AUTOMOTIVE REPAIRS - A lot or parcel used for the repair of vehicles such as cars, trucks, sport utilities,
motor homes, recreational vehicles or motorcycles. _ All repair work shall be conducted within an enclosed
building and no vehicle shall be stored outside an enclosed building for more than thi 30 days.
Section 4. This Ordinance shall be in full force and effect from and after its passage, approval, and
publication, according to law.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 7th day of
