HomeMy WebLinkAboutORD 2278INSTROMEN • q9 Iq BILL NO. 188 ORDINANCE NO. , 77 R AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE NOTICE WAS GIVEN; DETERMINING THAT VACATION OF SAID PUBLIC RIGHT -OF -WAY IN THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, DESCRIBED BELOW, SHALL BE MADE; DETERMINING THAT VACATION OF SAID FOLLOWING PROPERTY IS IN THE BEST PUBLIC INTEREST; AND PROVIDING FOR AN EFFECTIVE DATE. Vacation of the portion of right -of -way for Arlington Street lying between Elm and Hazel Streets; situated in the Southwest Quarter of the Northeast Quarter of the Southeast Quarter of Section 28, Township 4 North, Range 3 West, Boise Meridian and is part of Block 18 of Pioneer Subdivision to Caldwell, Idaho which plat is on file in Book 4 of Plats at page 52 in the office of the Recorder of Canyon County, Idaho; and said right -of -way is more particularly described as follows: Commencing at the Northeast Comer of the Southwest Quarter of the Northeast Quarter of the Southeast Quarter of said Section 28; thence South 0° 10'30" East along the East boundary of said Southwest Quarter of the Northeast Quarter of the Southeast Quarter, a distance of 25.0 feet to the TRUE POINT OF BEGINNING. Thence continuing South 0 °10'30" East, along the said East boundary, a distance of 274.0 feet; thence North 89 °5545" West a distance of 25.0 feet; thence North 0 °10'30" East, parallel with the East boundary of said Southwest Quarter of the Northeast Quarter of the Southeast Quarter a distance of 274.0 feet; thence North 89 1 55'45" East a distance of 25.0 feet to the TRUE POINT OF BEGINNING. Section 1. That by a motion passed by the Council and approved by the Mayor of the City of Caldwell, Idaho, and statutory notice having been given to the citizens and owners of property in the City of Caldwell, Idaho, in accordance with Section 50- 1306A, Idaho Code, that an application has been presented to the Mayor and Council of the City of Caldwell, Idaho, requesting passage and approval of an ordinance vacating the above described real property located in Caldwell, Canyon County, Idaho. Section 2. That a petition to vacate was submitted and that all affected easement holders have been notified of the petition to vacate by certified mail, return receipt requested and have agreed to same in writing.
