ORDINANCE NO. 2263
AN ORDINANCE TO PROVIDE AN R -1 (LOW - DENSITY RESIDENTIAL) ZONE
DESIGNATION FOR CERTAIN LANDS ANNEXED INTO THE CITY OF CALDWELL,
CANYON COUNTY, IDAHO, IN 1994; DETERMINING THAT SAID ZONING IS IN THE
BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE
COMMUNITY DEVELOPMENT DIRECTOR TO DESIGNATE SAID PROPERTY AS R -1 ON
THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND
RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the
recommendation of the Planning and Zoning Commission and following the public hearing procedures as
required by Idaho Code, Chapter 65, Local Planning Act, that the following described property be zoned
R -1 (Low - Density Residential) and that said zoning designation is in the best interest of the City of
Caldwell, Idaho.
SECTION 1. Said property consists of approximately 57.286 acres and is located on the east side of S.
10' Avenue and the north side of Homedale Road, and that the following described land is zoned R -I
(Low - Density Residential) after the date of passage of this Ordinance.
A parcel of land located in the SW 114 of Section 3, T.3N., R.3 W., B.M., Caldwell, Canyon County,
Idaho, more particularly described as follows: Commencing at the W I/4 of said Section 3 from which the
SW comer of said Section 3 bears South 00 °34'41" East, 2652.66 feet; thence along the West boundary
line of said Section 3 South 00 °34'41" East, 747.91 feet to a point on the centerline of the Phyllis Canal;
thence along said centerline the following two courses: South 60 °35'32" East, 40.74 feet; thence South
53 °15'41" East, 24.79 feet to the REAL POINT OF BEGINNING; thence North 00 °34'41" West, 226.47
feet; thence North 89'25'19" East 246.00 feet; thence South 00 °34'41" East 55.20 feet; thence South
47 1 03'26" East, 146.01 feet; thence North 44'25'19" East, 79.51 feet; thence South 45 ° 34'41" East,
56.00 feet; thence North 44'25'19" East 26.52 feet; thence South 45 °34'41" East, 100.22 feet; thence

North -South centerline of the SW1 /4 of said Section 3; thence along said North -South centerline South
00 °31'48" East, 692.10 feet to the SWI /16 corner of said Section 3; thence along the East -West
centerline of the SW1 /4 of said Section 3 North 89 0 00'47" East, 659.89 feet to the northeast corner of the
West 112 of the SE 1/4 of the SW 114 of said Section 3; thence along the East boundary line of said West
112 South 00 °30'22" East, 755.64 feet; thence leaving said East boundary line South 89 °29'38" West,
39.00 feet; thence South 00 ° 30'22" East, 167.30 feet; thence North 89 °29'38" East, 34.00 feet; thence

right; thence northwesterly along the arc of said curve 160.89 feet, said curve having a radius of 725.00
feet, a central angle of 12 and a long chord of 160.56 feet bearing North 51'26'05" West to a
point of tangency; thence North 45 °04'38" West, 250.17 feet to the beginning of a curve to the left;
thence northwesterly along the are of said curve 128.56 feet, said curve having a radius of 900.00 feet, a
central angle of 08 °11'03" and a long chord of 128.45 feet bearing North 49 0 10 1 09" West to a point of
tangency; thence North 53'15'41" West, 51.63 feet to the Real Point of Beginning. Containing 57.286
acres, more or less.
SECTION 2. The Community Development Director of the City of Caldwell, Idaho, is hereby instructed
to so designate the same above described property on the official zoning map of the City of Caldwell,
Idaho, as being C -3.
SECTION 3, All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
SECTION 4. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
