AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BY ADDING AND
DELETING CERTAIN LANGUAGE IN CHAPTER 8, ARTICLE 11 PERTAINING
TO FIREWORKS TIME OF SALE, TEMPORARY FIREWORKS STANDS AND
BUSINESS STRUCTURES: REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Section 5(3) of Chapter 8, Article 11 of the Municipal Code be
amended as follows:
08- 11 -05: TIME LIMITS:
(2)A. Request to reactivate Retail Sales Permit shall be filed with the City
Clerk on or before December 15 of the calendar year for which the
p ermit was issued. A twenty-five dollar Fire Dqpart ment inspection fee
shall be assessed to reactivate a Retail Sales Permit. Inspections of
stands have to be scheduled in advance with the Fire Marshal.
(3) Time of Sale: No "nonaerial common fireworks" shall be sold or
offered for sale except from twelve o'clock (12:00) Noon ens
on June 23 to twelve o'clock (12:00) midnight on July 5 and from
twelve o'clock 12:00 Midnight on December 26 and ending at twelve
o'clock (12:00) midnight on January 1 of each year.
Section 2. That Section 09 of Chapter 8, Article 11 of the Municipal Code be
amended as follows:
08- 11 -09: TEMPORARY FIREWORKS STANDS AND BUSINESS STRUCTURES:
(I)E. Each stand shall be provided with a minimum of two (2) 2A!QBC; fire
We each 2A and/or 2A -IOBC fire extinguishers which bear a
service tag dated within the last calendar year, hung 3' to 5' off of the
floor and easily accessible for use in case of fire.
(1)1.(a) No stand shall be erected before May 5 of any yees— the June 23
through July 5 sales period The premises on which the stand is erected
shall be cleared of all structures and debris not later than July 20.
(1)I.(b) No stand shall be erected before December 7 for the December 26
through January i sales period. The premises on which the stand is
erected shall be cleared of all structures and debris not later that Janu
15.
(1)M. All stairs, handrails. and landings shall comply with the current/
adopted version of the Uniform Building Code.
(1)N. All such buildings shall meet the structural stabilfty re uirements of the
most currently adopted version of the Uniform Building Code. All
electrical circuits and heating gpl2liances shall meet the current/
adopted appropriate Codes as determined by the Building_ Department.
(2)C. Each building shall be provided with such number of fire extinguishers,
as the City's Fire Chief shall deem adequate. The minimum number
shall not be less than two (2). The fire extinguishers shall be 2A1
wer-king a 2A and/or a 2A10BC fire extinauishers. which bear a
service tag dated within the last calendar year and hung--3' to 5' off of
the floor.
Section 3. All Ordinances or parts of Ordinances inconsistent herewith are
hereby repealed.
Section 4. This Ordinance shall be in full force and effect from and after its
passage, approval, and publication according to law.
