BILL NO. _32 ORDINANCE NO. 2253 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF CALDWELL, STATE OF IDAHO, CHAPTER 6, ARTICLE 5, PERTAINING TO DOOR TO DOOR SALESMEN BY ADDING A NEW SECTION 8, LOCATION RESTRICTION AND SECTION 10, INVESTIGATION OF APPLICANT AND DELETING AND ADDING CERTAIN LANGUAGE IN SECTION 11, LICENSE FEE: REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That a new Section 8, Location Restriction, of Chapter 6, Article 5 be added as follows: 06- 05 -08: LOCATION RESTRICTIONS: No licensee shall have any right to any fixed, reiaular, or established location in a public street or right of way nor shall he be permitted to conduct his business in an congested area where his ol2erations might im ede or inconvenience the public. The Judgment of a police officer is deemed conclusive as to whether the area if congested or the public impeded-or inconvenienced. No business activity shall be carried on in any area of the City by any licensee where such business activity is prohibited by the Cijy Zoning Code. No licensee shall be permitted to conduct his business or trade in or on any City park., building or adiacent gnunds. Section 2. That a new Section 10, Investigation of applicant, of Chapter 6, Article 5 be added as follows: 06- 05 -10: INVESTIGATION OF APPLICANT: Upon receipt of application, or al lication renewal, the City Clerk shall refer the application to the Chief of Police, who shall cause an investigation to determine the validity and completeness of information presented on the application. The Chief of Police shall endorse upon the application the fmdines of the investigation and return it to the City Clerk within 5 working days. Where an a lication for renewal of a license is involved and the Cily Clerk has received no complaints or allegations of any violation of this Chapter or other laws by the applicant the Clerk may approve application without referral of the application to the Chief of Police. Section 3. That Section 11, License Fee, of Chapter 6, Article 5 be amended by deleting and adding certain language as follows: 4V 06- 05 -11: LICENSE FEE: A license fee shall be paid of ana .per- ge"an p fifty dollars ($50.00) per person for three (3) months. The license shall be exhibited in a conspicuous place if the licensee is using a vehicle or a building in s lb . 4 0 0 his business and otherwise must be kept by the person and exhibited at any time upon request. Section 4. That Section 17 (2), Portable and Stationary Stands, of Chapter 6, Article 5 be amended by adding and deleting certain language as follows: 06- 05 -17: PORTABLE AND STATIONARY STANDS: (2) License Fee: The license fee shall be made to the City Clerk's Office at a rate of fifty della M ($50.00) ° -n^ Twenty -five dollars ($25.00) for three months. Section 5. All Ordinances or parts of Ordinances inconsistent herewith are hereby repealed. Section 6. This Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
