ORDINANCE NO. 111
AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO, THAT THE MAYOR AND THE
CITY COUNCIL INTEND TO SELL THE FOLLOWING DESCRIBED REAL
PROPERTY OWNED BY THE CITY OF CALDWELL. CANYON COUNTY,
IDAHO; AND WHICH SAID PROPERTY IS SITUATED IN CANYON COUNTY,
IDAHO; THAT SAID SALE IS MADE UNDER THE PROVISIONS OF TITLE 50,
CHAPTER 14, IDAHO CODE; THAT SAID SALE OF SAID PROPERTY SHALL
BE AT PUBLIC AUCTION AND SHALL BE SOLD TO THE HIGHEST BIDDER
AND THAT NO BID SHALL BE ACCEPTED FOR LESS THAN THE
APPRAISED VALUE; SAID PROPERTY BEING DESCRIBED AS FOLLOWS:
All that certain lot, piece or parcel of land situated in the City of Caldwell, County
of Canyon, and State of Idaho, described in Instrument No. 8626444 dated August
27, 1986 and recorded October 22, 1986, bounded and described as follows:
A parcel of land being on the easterly side of the easterly right of way boundary
of the Northwest Connector Survey as shown on the plans of Interstate 84,
formerly Interstate 80N Project No. I -80N -1 (67) 27 Highway Survey now on file
in the office of the Idaho Transportation Department, Division of Highways, and
being a portion of the NE' /4NE' /4 of Section 21, Township 4 North, Range 3 West,
B.M., described as follows, to-wit: Beginning at the intersection of southeasterly
line of the tract of land as described in that certain Warranty Deed, dated August
20, 1980 recorded August 22, 1980 as Instrument No. 900344 records of Canyon
County, Idaho and a line parallel with and 170.0 feet southeasterly from the
centerline of the Northwest Connector Survey as shown on the plans of said
Interstate 84, formerly Interstate 80N, Project No. I -80N -1 (67) 27 Highway
Survey and shown of record to be 623.0 feet southeasterly, 421.0 feet
southwesterly and 85.0 feet, more or less, from the point where the centerline of
Belmont Street in the City of Caldwell, Idaho, extended, intersects the
southeasterly boundary of the right of way of the Riverside Irrigation District,
Ltd., and bears South 75 °51'21" East from Station 67 +22.38 of said Northwest
Connector Survey; thence North 14 °08'39" East along said parallel line 177.62
feet to a point opposite Station 68+00 of said Northwest Connector Survey;
thence North 8 0 26'28" East — 439.72 feet to a point in a line parallel with and
100.0 feet southwesterly from the centerline of said Belmont Street; thence South
46° 15'13" East along said last parallel line 350.0 feet, more or less, to a point in
the southeasterly line of said tract of land; thence southwesterly along said
southeasterly line 370.0 feet, more or less, to the southeast corner of said tract of
land; thence westerly along the south line of said tract of land 85.0 feet, more or
less, to the POINT OF BEGINNING, Northwest Connector Survey Station
Reference: 67 +22.38 to72 +35. The area above described contains approximately
2.150 acres. The bearings as shown in the above land description, unless
otherwise noted, are from the Idaho Plane Coordinate System, based on the
transverse mercator projection for West Zone of Idaho. The Idaho Transportation
Department, Division of Highways, excepts and reserves unto itself, its successors
or assigns, all existing, future or potential common law or statutory easements of
access, ingress, to, from or between the property herein conveyed and the right of
way of the public way identified as the Northwest Connector to Interstate 84,
formerly Interstate Highway No. 80N, Project No. I -80N -1 (67) 27. The Idaho
Transportation Department, Division of Highways, also reserves unto itself the
right to prohibit the erection or construction of any buildings or structures except
irrigation or drainage structures within 20 feet of the right of way of said
Northwest Connector to Interstate 84, formerly Interstate Highway No. 80N,
Project No. I -80N -1 (67) 27. The Idaho Transportation Department, Division of
Highways, also reserves unto itself the right to prohibit the erection or
construction of any advertising signs, displays or devices on the property herein
conveyed. The Idaho Transportation Department, Division of Highways, also
reserves unto itself the right to prohibit the use of the property herein conveyed as
a junkyard or dump.
BE IT ORDAINED AND ESTABLISHED BY THE MAYOR AND COUNCIL OF
THE CITY OF CALDWELL, CANYON COUNTY, IDAHO:
Section 1. That the Mayor and Council of the City of Caldwell, Idaho, hereby intend to
sell at public auction the previously described real property situated within Canyon
County, Idaho.
Section 2. That the ordinance for the safe of said above described real property will be
considered under a suspension of the requirements that an ordinance be read on three
different days at a meeting of the Council of the City of Caldwell, Idaho, and that a
Public Hearing and auction will be held on the 17' day of August, 1998, at the hour of
seven (7:00) p.m. at the Council Chambers in the City Hall in the City of Caldwell,
Idaho, when and where, or prior to said date, any citizen may express dissatisfaction with
question of whether or not the real property shall be sold.
Section 3. The said above described property shall be sold at a public auction to the
highest bidder and no bid shall be accepted for less than the appraised price and the City
Council may reject any and all bids.
Section 4. Notice of the foregoing will be given to all citizens of the City of Caldwell,
Idaho, in two issues thereof published in the local newspaper on August 3 and 10, 1998.
Section 5. That this ordinance shall be in force and effect from and after its passage,
approval and publication.
