" ORDINANCE NO. 2218 AN ORDINANCE CHANGING THE ZONING OF CERTAIN LANDS WITHIN THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, FROM R -3 TO C -3; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE COMMUNITY DEVELOPMENT DIRECTOR TO DESIGNATE SAID PROPERTY AS C -3 ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in Section 10- 03 -03, Caldwell Municipal Code, that the following described property be rezoned from R -3 to C -3 (Service Commercial) and that said rezoning is in the best interest of the City of Caldwell, Idaho. SECTION 1. Said property consists of approximately 0. 12 acres and is located at the southeast intersection of Freeport Street and 11 m Avenue, and that the following described land is zoned C -3 (Service Commercial) after the date of passage of this Ordinance. A portion of Lots 19, 20, 21, 22, 23, and 24 of Block 55 of Boone's Addition to the City of Caldwell, as shown on Official Plat thereof on file in Book 2 at Page 56 in the Office of the County Recorder for Canyon County, Idaho, lying in the NW 114 SE 114 and more particularly described as follows: Commencing at the southerly corner of said Lot 19; thence North 0° 28' 10" East along the east boundary of said Block 55 a distance of 68,69 feet to a point which lies on a line 50.00 feet northeasterly from and parallel with the southwesterly boundary of said Lots 19 through 24; said point is the TRUE POINT OF BEGINNING; thence North 46° 15' 51" West along said parallel line a distance of 106.91 feet to a point on the northwesterly boundary of said Block 55; thence North 43 44'47" East along said northwesterly boundary a distance of 70.09 feet to the northerly corner of said Block 55; thence South 46' 16'23" East along the northeasterly boundary of said Block 55 a distance of 40.92 feet to a point on said east boundary of said Block 55; thence South 0° 28' 10" West along said east boundary a distance of 96.26 feet to the TRUE POINT OF BEGINNING, containing 0.12 acres, more or less. Section 2. The Community Development Director of the City of Caldwell, Idaho, is hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho, as being C -3. Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. 0 • Section 4. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
