ORDINANCE NO. 2189
AN ORDINANCE AMENDING CHAPTER 6, ARTICLE 9, OF THE MUNICIPAL CODE
OF THE CITY OF CALDWELL PERTAINING TO TREE TRIMMERS BY DELETING AND
ADDING CERTAIN LANGUAGE IN SECTION 03 PERTAINING TO APPLICATION FOR
LICENSE; SECTION 05 PERTAINING TO LICENSE FEE; AND SECTION 09
PERTAINING TO RIGHT OF APPEAL: REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
Section 1. That Section 03, of Chapter 6, Article 9 of the
Municipal Code of the City of Caldwell, County of Canyon, State of
Idaho, pertaining to Application for License be amended as follows:
06- 09 -03: APPLICATION FOR LICENSE: Application for such license
shall be made to the C-effimuni-ty Serariees n; wAptn
Forestry /Horticulturist on a form to be furnished by the City. The
application shall be signed by the applicant and shall show such
information as may be required by the
Forestry /Horticulturist.
Section 2. That Section 05 of Chapter 6, Article 9 of the
Municipal Code of the City of Caldwell, County of Canyon, State of
Idaho, pertaining to License Fee be amended as follows:
06 09 - 05: LICENSE FEE: The r
Forestry /Horticulturist shall either approve or disapprove each
application. If the application is approved, then the applicant
shall pay a license fee of twenty -five dollars ($25.00) per annum.
Such license shall be issued for the calendar year or the balance
of the calendar year only.
Section 3. That Section 09 of Chapter 6, Article 9 of the
Municipal Code of the City of Caldwell, County of Canyon, State of
Idaho, pertaining to Right of Appeal be amended as follows:
06- 09 -09: Right of Appeal: If the Cgmmunity 5eL=,4Ge__s Dire�ter
Forestry /Horticulturist shall disapprove an application for a
license, the applicant shall have the right, within the period of
ten (10) days from the date of such disapproval, to appeal to the
City Council and the decision of the City Council shall be final.
Section 4. All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.

Section 5. This Ordinance shall be in full force and effect
from and after its passage, approval and publication according to
law.
