AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL, IDAHO FROM COUNTY A (AGRICULTURAL) TO CITY R -1
(SINGLE FAMILY RESIDENTIAL); DETERMINING THAT SAID CHANGE IN ZONING
IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING
THE COMMUNITY DEVELOPMENT DIRECTOR TO DESIGNATE SAID PROPERTY
AS R -1 ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS,
ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, Idaho;
AREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon
the recommendation of the Planning and Zoning Commission and following the public hearing
procedures as required in Section 10 -03 -03 Caldwell Code. that the following described property
be rezoned from County A (Agricultural) to City R -1 (Single Family Residential) and that said
rezoning is in the best interest of the City of Caldwell, Idaho.
Said property consists of approximately 3.8 acres and is located south of Palrang Drive between
S. Montana Avenue and S. Oregon Avenue and more particularly described as follows:
Commencing at the W1116 corner of Section 3, T3N, R3W, B.M. , thence N 00 12 W
a distance of 1226.40 feet to the POINT OF BEGINNING,
Thence continuing N 00 12'46" W a distance of 156 feet to a point on the northerly right -
of -way of Pahang Drive,
Thence N 89 17' 47" E a distance of 1322.99 to a point on the centerline of South
Montana Avenue,
Thence S 00° 07' 19" E a distance of 156 feet along the centerline of South Montana
Avenue,
Thence S 89° 17'47" W 1322.77 feet to a point on the western boundary of the SE114,
NW1I4 of said Section 3, T3N, R3W, B.M. to the POINT OF BEGINNING.
Said total property to be annexed consists of 3.8 acres more or less.
IT IS HEREBY ORDAINED AS FOLLOWS:
Section I. That certain land described above is now zoned R -1 (Single Family Residential) after
the date of this ordinance.
Section 2. The Community Development Director of the City of Caldwell is hereby instructed
to so designate the same above described property on the official zoning map of the City of
Caldwell, Idaho, as being R -1.
Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby
repealed, rescinded and annulled.
