HomeMy WebLinkAboutORD 2175BILL NO. 1 ORDINANCE NO. 2 r , AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO FROM R -1 (SINGLE FAMILY RESIDENTIAL) TO R -3 (MULTI- FAMILY HIGH DENSITY RESIDENTIAL); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS R -3 ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH, BE IT ORDAINED by the Mayor and Council of the City of Caldwell, Idaho; WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in Section 10 -03 -03 Caldwell Code, that the following described property be rezoned from R -1 (Single Family Residential) to R -3 (Multi - Family High Density Residential) and that said rezoning is in the best interest of the City of Caldwell, Idaho. Said property consists of approximately two point seven (2.7) acres and is located on approximately nine hundred (900) feet south of Ustick Road on the east side of S. Tenth Avenue and more particularly described as follows: Commencing at a 1" bolt marking the Northwest corner of Government Lot 4, Section 3, T3N, R3W, B.M., Caldwell, Canyon County, Idaho; Thence South 00° 34' 53" East, a distance of 962.88 feet along the West line of said Government Lot 4, Section 3; Thence North 89° 25' 07" East, a distance of 40.00 feet to a point on a line parallel to and 40.00 feet Easterly of said West line, said point being the REAL POINT OF BEGINNING; Thence North 00° 34' 53" West, a distance of 320.00 feet along said parallel line; Thence North 89° 25' 07" East, a distance of 367.31 feet; Thence South 00° 53' 40" East a distance of 320.00 feet; Thence South 89° 25' 07" West a distance of 369.06 feet to the REAL POINT OF BEGINNING. 05ZON.p.1 IT IS HEREBY ORDAA AS FOLLOWS: Y Section 1. That certain land described above is now zoned R -3 (Multi- Family High Density Residential) after the date of this ordinance. Section 2. The Planning and Zoning Director of the City of Caldwell is hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho, as being R -3. Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 4. This ordinance shall be in full force and effect from and after its passage.
