0 0 BILL NO. 37 ORDINANCE NO. 2165 AN ORDINANCE CHANGING THE ZONING OF CERTAIN LAND WITHIN THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO FROM R -1 (SINGLE FAMILY RESIDENTIAL) TO CA (NEIGHBORHOOD COMMERCIAL); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS C -1 ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, and following the public hearing procedures as required in Section 10 -03 -03 Caldwell Municipal Coe that the following described property be rezoned from R -1 to C -1 (Neighborhood Commercial) and that said rezoning is in the best interest of the City of Caldwell, Idaho. SECTION 1. That the following described land is now zoned C -1 (Neighborhood Commercial) after the date of this ordinance. The said property consists of approximately ten point nine five (10.95) acres and is located generally on the southeast corner of S. 10th Avenue and Ustick Road and more particularly described as follows: Commencing at a 1" bolt marking the Northwest corner of Government Lot 4, Section 3, T3N, R3W, B.M., Caldwell, Canyon County, Idaho; thence North 89" O6', 20" East, 40.00 feet along the North boundary line of said Government Lot 4, Section 3; thence South 00° 34'53" East, a distance of 40.00 feet to a point on a line parallel to and 40.00 feet southerly of said north line, said point being the REAL POINT OF BEGINNING; thence North 89° 06'20" East, a distance of 786.01 feet along said parellei ; thence South 00 0 53'40" East, a distance of 607.40 feet; 06ZON.WPD 1 thence South 89 25'07" West, a distance of 789.32 feet to a point on a line parallel to and 40.00 feet Easterly of the West line of said Government Lot 4 of Section 3; thence North 00° 34' 53" West, a distance of 603.09 feet along said parallel line to the REAL POINT OF BEGINNING; SECTION 2. The Planning and Zoning Director of the City of Caldwell is hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho as being C -1. SECTION 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 4. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
