ORDINANCE NO. 2161
AN ORDINANCE DETERMINING THAT CERTAIN LAND LYING WITHIN THE CITY
LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BE
DISANNEXED FROM THE INCORPORATED AREA AND EXCLUDED THEREFROM
UNDER THE POWERS GIVEN TO CITIES IN IDAHO BY THE STATE CODE;
DECLARING THAT SAID LANDS DESCRIBED HEREIN BE EXCLUDED FROM THE
BOUNDARIES OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, BY PROPER
LEGAL DESCRIPTION; DETERMINING THAT THE LANDS BE CHANGED AND
REDESIGNATED ON THE OFFICIAL ZONING MAPS OF SAID CITY AND COUNTY;
DETERMINING THERE IS NO INDEBTEDNESS TO THE CITY OF CALDWELL BY
OUTSTANDING BOND OR IMPROVEMENT DISTRICT IN EXISTENCE AT THE TIME OF
PASSAGE, APPROVAL AND PUBLICATION OF THIS ORDINANCE; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT
HEREWITH; AND DIRECTING THE CITY ENGINEER TO CHANGE THE BOUNDARIES
ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
SECTION 1. That the lands described below are located within the incorporated area of
the City of Caldwell, Idaho and have been requested by the owner of said property to be
disannexed from the City:
A parcel of land lying in the Northeast Quarter, Section 1, Township 3 North, Range
3 West, Boise Meridian, City of Caldwell, Canyon County, Idaho and more
particularly described as follows:
Commencing at the Northeast corner of the Northwest Quarter of the Northeast
Quarter of said Section 1; thence North 89° 54'42" West along the North boundary
of said Northwest Quarter of the Northeast Quarter a distance of 171.09 feet to a
point on the southwesterly right -of -way of the Oregon Shortline Railroad and the
REAL POINT OF BEGINNING;
Thence along said right -of -way South 46 15' 00" East a distance of 270.00 feet;
Thence leaving said right -of -way South 41 ° 45' 08" West a distance of 225.97 feet
to a point of curvature;
Thence along a curve to the left a distance of 182.50 feet; said curve having a
central angle of 36° 18' 53 ", a radius of 287.94 feet, tangents of 94.43 feet, and a
long cord of 179.46 feet bearing South 23 24' 34" West to a point of tangency;

Thence South 05° 15'08" West a distance of 920.39 feet;
Thence South 43° 44' 26" West a distance of 41.37 feet;
Thence North 46° 15' 12" West a distance of 809.74 feet;
Thence North 00 19' 04" East a distance 907.60 feet to point on the North
boundary of said Northwest Quarter of the Northeast Quarter;
Thence along said North Boundary South 89 54'42" East a distance of 719.52 feet
to the POINT OF BEGINNING. Said parcel contains 19.93 acres more or less.
SECTION 2. That, pursuant to 50 -225, Idaho Code the Councils of cities in the State of
Idaho are granted power to enact ordinances for the purpose of altering and excluding
territory from the boundaries of the City.
SECTION 3. That the alteration shall not relieve any territory excluded from the limits of a
city from any liability on account of any outstanding bonded or other indebtedness of any
improvement district of which the excluded territory is an existing part at the time of
passage of such ordinance.
SECTION 4. That no such indebtedness or bond exists as of the date of this ordinance.
SECTION 5. That public hearings have been held by the Planning and Zoning Commission
and City Council in accordance with the procedures set forth in 67 -6509, Idaho Code to
establish a land use and zoning designation for said parcels upon disannexation.
SECTION S. That it is hereby declared by the Mayor and Council of the City of Caldwell,
Idaho that the land herein described by proper legal description is hereby disannexed from
the incorporated boundaries of the City of Caldwell, Idaho.
SECTION 7. All conflicting ordinances, resolutions, orders or parts thereof are hereby
repealed, rescinded and annulled.
SECTION 8. This ordinance shall be in full force and effect from and after its passage,
approval and publication according to law.
SECTION 9. All of the lands described in this ordinance shall be subject to taxation as
other property and persons within the County of Canyon, State of Idaho, and the State Tax
Commission, State of Idaho.
