HomeMy WebLinkAboutORD 2159R BILL NO. 3L ORDINANCE NO. 215 AN ORDINANCE CHANGING THE ZONING OF CERTAIN LAND WITHIN THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO FROM COUNTY R -1 (SINGLE FAMILY RESIDENTIAL) TO CITY R-1 (SINGLE FAMILY RESIDENTIAL); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS R -1 ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, and following the public hearing procedures as required in Section 10 -03 -03 Caldwell Municipa Cgde, that the following described property be rezoned from County R -1 to City R -1 (Single Family Residential) and that said rezoning is in the best interest of the City of Caldwell, Idaho. SECTION 1. That the following described land is now zoned R -1 (Single Family Residential) after the date of this ordinance. The said property consists of approximately point nine two (.92) of an acre and is located generally west of S. Montana Avenue (3708 S. Montana Avenue) and more particularly described as follows: Commencing at the Southwest corner of the Southeast Quarter of the Southwest Quarter of Section 34, Township 4 North, Range 3 West of the Boise Meridian, Canyon County, Idaho; thence North 89 ° 20'30" East along the South boundary of said Southeast Quarter of the Southwest Quarter, a distance of 395.0 feet; thence North V 41'45" East, a distance of 727.05 feet to a point on the center line of the Caldwell Low Line Canal; thence North 49 25'00" West along the centerline of said canal, a distance of 289.73 feet; thence North 11 ° 36' 00" West along the centerline of said canal, a distance of 205.11 feet to the TRUE POINT OF BEGINNING; thence continuing North 11 36'00" West along the centerline of said canal a distance of 203.75 feet to a point on the North boundary of said Southeast Quarter of the Southwest Quarter, which point is 119.56 feet Easterly from the Northwest corner of said Southeast Quarter of the Southwest Quarter; 06ZON.WPn 1 16 0 0 thence North 89° 24'30" East along the North boundary of said Southeast Quarter of the Southwest Quarter a distance of 1204.80 feet; to a point being the Northeast corner of said Southeast Quarter of the Southwest Quarter; thence South 0" 15'30" West a distance of 40.00 feet along the easterly boundary of said Southeast Quarter of the Southwest Quarter; thence South 89° 24' 30" West a distance of 640.75 feet and parallel to the northerly boundary of said Southeast Quarter of the Southwest quarter; thence North 1' 11' 30" West a distance of 10.00 feet: thence South 89" 24' 30" West a distance of 343.35 feet; thence South 0 35'30" East a distance of 170.00 feet; thence South 89° 24' 30" West a distance of 181.09 feet to the TRUE POINT OF BEGINNING. SECTION 2. The Planning and Zoning Director of the City of Caldwell is hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho as being R -1. SECTION 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 4. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
