" ORDINANCE NO. 215 AN ORDINANCE CHANGING THE ZONING OF CERTAIN LAND WITHIN THE CITY OF OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO FROM COUNTY R -1 TO CITY (MULTI- FAMILY HIGH DENSITY RESIDENTIAL); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS R -3 ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in Section 10 -03 -03 Caldwell Municipal Code, that the following described property be rezoned from County R -1 to City R -3 (Multi- Family High Density Residential) and that said rezoning is in the best interest of the City of Caldwell, Idaho. SECTION 1. That the following described land is now zoned City R -3 (Multi - Family High Density Residential) after the date of this ordinance. The said property consists of approximately 3.72 acres and more particularly described as follows: Commencing at the Center 1/4 Corner of Section 33, T 4 N, R 3 W, B.M., Canyon County, Idaho; thence N 0 °39'34" E, (formerly N 0 °39'48" E.) 1324.60 feet to the NW Corner of the said N1/2, SW 114, NE 1/4 Section 33; thence S 89 "28'13" E 1322.88 feet along the north boundary of the said N Y2, SW 114, NE 114, Section 33; thence N 89 28'13" W (formerly West) 354.00 feet along said north boundary of the N 1 /2 SW 114, NE 114, Section 33; thence S 13° 43'21" E (formerly S 14 °15' E) 244.19 feet to the REAL POINT OF BEGINNING; thence continuing S 13 °43'21" E (formerly S 14 °15' E) 406.68 feet to a point on the northerly right of way of Beech Street; thence N 89 °32'41" W, 460.71 feet along said right of way of Beech Street; thence N 0 °27'19" E, 394.29 feet; thence S 89 °32'41" E, 361.10 feet to the POINT OF BEGINNING, containing 3.72 acres. The Planning and Zoning Director of the City of Caldwell is hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho as being R -3. SECTION 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 4. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
