AN ORDINANCE CHANGING THE ZONING OF CERTAIN LAND WITHIN THE CITY OF
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO FROM COUNTY R -1 TO
CITY R -1 (SINGLE FAMILY RESIDENTIAL); DETERMINING THAT SAID CHANGE IN
ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO;
INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID
PROPERTY AS R -1 ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS,
ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho,
upon the recommendation of the Planning and Zoning Commission and following the public
hearing procedures as required in Section 10 -03 -03 Caldwell Municipal Code, that the
following described property be rezoned from County R -1 to City R -1 (Single Family
Residential) and that said rezoning is in the best interest of the City of Caldwell, Idaho.
SECTION 1. That the following described land is now zoned City R -1 (Single Family
Residential) after the date of this ordinance.
The said property consists of approximately 4.47 acres and more particularly described as
follows:
Commencing at the Center 114 Corner of Section 33, T 4 N, R 3 W, B.M., Canyon
County, Idaho;
thence N 0 °39'34" E, (formerly N 0 °39'48" E.) 1324.60 feet to the NW Corner of the said
N1/2, SW 114, NE 114 Section 33;
thence S 89 °28'13" E 1322.88 feet along the north boundary of the said N Y2, SW 1/4, NE
114, Section 33;
thence N 89° 28'13" W (formerly West) 354.00 feet along said north boundary of the N1/2
SW 114, NE 1/4, Section 33 to the REAL POINT OF BEGINNING;
thence S 13 °43'21" E (formerly S 14 °15' E) 244.19 feet;
thence N 89 °32'41" W, 36 1. 10 feet:
thence S 0° 27'19" W, 394.29 feet to a point on the northerly right of way of Beech Street;
thence N 89 °32'41" W, 156.28 feet along the northerly right of way of Beech Street to a
point;
thence N 4 °37'20" W (formerly N 5 °10' W) 634.19 feet along the westerly boundary of an
existing irrigation ditch to a point on the said north boundary of the N1/2, SW 1/4,
NE 1/4, Section 33;

thence S 89 °28'13" E, 513.70 feet along said north boundary of the N1/2, SW 114, NE 114,
Section 33 to the POINT OF BEGINNING containing 4.47 acres to be zoned as R -1.
SECTION 2. The Planning and Zoning Director of the City of Caldwell is hereby instructed
to so designate the same above described property on the official zoning map of the City
of Caldwell, Idaho as being R -1.
SECTION 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 4. This ordinance shall be in full force and in effect from and after its passage,
approval and publication, according to law.
