HomeMy WebLinkAboutORD 2147jr BILL NO. 19 ORDINANCE NO. 2147 AN ORDINANCE CHANGING THE ZONING OF CERTAIN LAND WITHIN THE CITY OF OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO FROM COUNTY A TO CITY C-4AP (INTERCHANGE OR FREEWAY COMMERCIAL, AIRPORT OVERLAY); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS C-4AP ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in Section 10 -03 -03 Caldwell Municipal Code, that the following described property be rezoned from County A to C-4AP (Interchange or Freeway Commercial, Airport Overlay) and that said rezoning is in the best interest of the City of Caldwell, Idaho. SECTION 1. That the following described land is now zoned C-4AP (Interchange or Freeway Commercial, Airport Overlay) after the date of this ordinance. The said property consists of approximately forty point four eight acres and is located generally East of Interstate 84 and at the north end of Andy Lane (1311 Andy Lane) and more particularly described as follows: Commencing at the Northeast corner of the Northeast Quarter of the Northeast Quarter Section 26, T4N, R3W, B.M.; thence S 0° 11' 00" E East 1,275.41 feet (Formerly described as S 0 07' 00" E 1,275.74 feet) along the boundary of said Northeast Quarter of the Northeast Quarter; Thence S 89° 28'22" W 909.32 feet (Formerly described as S 89° 29' 10" W 900.84 feet) parallel with and 50 feet north of the South Boundary of said Northeast Quarter to a point on the Easterly Boundary of the right of way for Interstate 80; Thence N 21 Degrees 21' 08'43" W (Formerly described as N 21 06' 45" W 423.35) 243.74 feet to the POINT OF BEGINNING; Thence continuing N 21 08'43" West 423.35 feet along the Easterly Boundary of the right of way for Interstate 80; I Thence N 89° 25'51" E 239.77 feet (Formerly described as N 89° 29'45" E 238.09 feet) along the North Boundary of Lots 15 and 16, City View Tracts, to a point on the centerline of the Caldwell High Line Canal; Thence traversing the centerline of said Caldwell High Line Canal as follows: S 79 27'25" E 90.79 feet (Formerly described as S 79° 25'25" E 92.83 feet); Thence N 75° 38' 25" E 163.79 feet (Formerly described as N 75° 40'25" E); Thence S 34° 45' 14" E 319.91 feet (Formerly described as S 34 43' 15" E); Thence S 15° 10' 35" E 74.55 feet (Formerly described as S 15" 08' 35" E); Thence leaving the centerline of said Caldwell High Line Canal S 80° 51' 12" W 543.77 feet to the POINT OF BEGINNING. SECTION 2. The Planning and Zoning Director of the City of Caldwell is hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho as being C-4AP. SECTION 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 4. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
