BILL NO. 16 ORDINANCE NO. 2144 AN ORDINANCE CHANGING THE ZONING OF CERTAIN LAND WITHIN THE CITY OF OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO FROM COUNTY A TO CITY C4AP (INTERCHANGE OR FREEWAY COMMERCIAL, AIRPORT OVERLAY); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS C-4AP ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in Section 10 -03 -03 Caldwell Municipal Code that the following described property be rezoned from County A to C-4AP (Interchange or Freeway Commercial, Airport Overlay) and that said rezoning is in the best interest of the City of Caldwell, Idaho. SECTION 1. That the following described land is now zoned C-4AP (Interchange or Freeway Commercial, Airport Overlay) after the date of this ordinance. The said property consists of approximately forty-three acres and is located generally East of Interstate 84 and South of Idaho State Highway 20 -26 (Franklin Road) and more particularly described as follows: Commencing at the northwest corner of the NE 114 (the north 114 corner) of Section 26, T4N, R3W, B.M., thence N 89 0 34'30" E 370.12 feet along the north line of the NE 114 of said Section 26 to the REAL POINT OF BEGINNING of this description; Thence continuing N 89 0 34'30" E 2,264.91 feet along the north line of the NE 114 to the northeast corner of Section 26; Thence S 00 0 00'00" E 2,306.25 feet along the east line of the NE 114 to a point; Thence N 61 0 08'00" W 309,00 feet to a point; Thence N 40 0 24'00" W 88.60 feet to a point; 03zon.wpd 1 Thence N 19 °08'00" W 366.80 feet to a point; Thence N 00 °05'00" E 104.00 feet to a point; Thence N 29 °48'00" E 264.00 feet to a point; Thence N 14 0 40'00" W 553.00 feet to a point; Thence N 30 0 55'00" W 194.00 feet to a point; Thence N 39 °35'00" W 102.60 feet to a point; Thence N 78 °10'00" W 87.90 feet to a point; Thence S 64 0 28'00" W 103.50 feet to a point; Thence N 87 0 54'00" W 103.00 feet to a point; Thence S 46 W 5.34 feet to a point; Thence S 89 °37'00" W 239.77 feet to a point on the easterly right -of -way of 1 -84; Thence continuing S 89 0 37'00" W 396.82 feet to a point on the westerly right -of -way of 1 -84, said point being on a curve; Thence along said westerly right -of -way along a curve to the left 300.78 feet, said curve having a radius of 1,016.83 feet, a central angle of 16 °56'54 ", tangents of 151.50 feet, and a long chord which bears N 51'57'03" W 299.69 feet to a point of tangency; Thence N 60 0 25'30" W 322.03 feet along said westerly right -of -way to a point of curvature; Thence along said westerly right -of -way along a curve to the right 258.31 feet, said curve having a radius of 370.00 feet, a central angle of 40 °00'00 ", tangents of 134.67 feet, and a long chord which bears N 40" 25'30" W 253.09 feet to a point of tangency; Thence N 20 °25'30" W 114.30 feet along said westerly right -of -way to the REAL POINT OF BEGINNING. Said parcel of land contains 43.76 acres more or less. 03zon.wpd 2 0 SECTION 2. The Planning and Zoning Director of the City of Caldwell is hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho as being C-4AP. SECTION 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 4. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
