ORDINANCE NO. 2111
AN ORDINANCE OF THE CITY OF CALDWELL, A MUNICIPAL
CORPORATION OF IDAHO, PURSUANT TO THE LOCAL PLANNING ACT,
IDAHO STATE CODE, 67-6501, ET.SEQ, AMENDING CHAPTER 10,
ARTICLE 3, SECTION 6 PERTAINING TO FEE SCHEDULE AND
CHAPTER 10, ARTICLE 2, SECTION 9 (3) PERTAINING TO HOME
OCCUPATIONS BY DELETING AND ADDING LANGUAGE REGARDING
FEES FOR PLANNING AND ZONING DEPARTMENT; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN
CONFLICT HEREWITH; AND PROVIDING AND AUTHORIZING THE CITY
COUNCIL FOR CHANGING OR AMENDING THE FEE SCHEDULE FOR
PLANNING AND ZONING BY RESOLUTIONS AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
Section 1. That Chapter 10, Article 3, Section 6 of the
Municipal Code of the City of Caldwell, County of Canyon, State of
Idaho, shall be repealed and a new Section 6 be added as follows:
10:03 -06: The City Council shall establis specific fees
by Resolution for the followin
1. Administrative Approval
2. Annexation
3. Appeal
4. Code Amendment
5. Comprehensive Plan Amendment
6. Planned Unit Developments
7 Plats
S. Sipecial Use Permit
9. Vacation of Right of way and utility easements
10. Variance
11. Zone Change
12. Home Occupation Permit
Section 2. That Chapter 10, Article 2, Section 9 (3) of the
Municipal Code of the City of Caldwell, County of Canyon, State of
Idaho, shall be amended as follows:

by the City Council by Resolution and may be issued for
the term of the home occupation but shall not be
transferable from one individual or property owner to

another. Home occupation permits shall meet all of the
following terms and conditions:
A. The use is clearly incidental and secondary to the
use of the dwelling for dwelling purposes.
B. The use is conducted entirely within a dwelling and
is carried on by the inhabitants thereof.
C. No article shall be sold or offered for sale on the
premises, except such as is lawfully produced by the
occupant on the premises.

D. The use does not change the character of the dwelling
or adversely affect the uses permitted in the zoning
districts.
E. The use requires no additional off - street parking
spaces.
F. No persons are employed other than those necessary
for domestic purposes.
G. Not more than one- fourth (1/4) of the gross area of
the one floor of said dwelling is used for such use.
Section 3. All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 4. This Ordinance shall be in full force and effect
from and after its passage, approval, and publication according to
law.

RESOLUTION NO. 79 -95
A RESOLUTION OF THE CITY OF CALDWELL APPROVING AND
ESTABLISHING VARIOUS FEES FOR THE CALDWELL PLANNING AND
ZONING DEPARTMENT.
NOW, THEREFORE, BE IT RESOLVED By the Mayor and City
Council of the City of Caldwell that the fees for the Caldwell
Planning and Zoning Department as set forth in the petition below
and made a part hereof are hereby adopted by the City Council of
the City of Caldwell and will be in effect upon passage of this
Resolution:
FEES FOR SERVICES OF THE PLANNING AND ZONING DEPARTMENT
1. To amend the text of the zoning regulations or amend the
zoning boundary of any zoning district:
A. Change zoning boundaries: $ 150.00 plus
advertising.
B. Change the zoning regulations' text: $ 150.00
plus advertising.
2. For a Special Use Permit: $ 150.00 plus advertising.
3. Planned Unit Development Applications:
A. First 99 units, $ 100.00 plus advertising.
B. 100 to 299 units, $ 200.00 plus advertising.
C. Over 300 units, $ 300.00 plus advertising.
4. For a Variance: $ 100.00 plus advertising.
5. Change to Comprehensive Plan: $150.00 plus advertising.
6. Vacation of streets, rights -of -way and non- utility
easements. $ 150.00 plus advertising.
7. Vacation of utility easements: $ 75.00.
8. Second or additional hearings: $ 50.00 plus advertising.
9. Administrative approvals: $25.00.
10. Appeals: $ 100.00 plus advertising.

12. Home Occupation Permits: $ 10.00.
13. Plat, Short (10 Lots or less): $50.00 + $ 5.00 per lot
plus advertising.
14. Plat, Preliminary (11 Lots or more) : $100.00 + $5.00 per
lot plus advertising.
15. Plat Extension or Modification: $ 25.00.
16. Plat, Final: $ 50.00 + $5.00 per lot plus advertising.
