HomeMy WebLinkAboutORD 21060 0 BILL NO. 42 ORDINANCE NO. 210 AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO; AND THAT SAID LAND BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREAS TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: SECTION 1. That the following described land is contiguous and adjacent to the City of Caldwell, Idaho on the North, East and West and that the City has received a request that said following described land should be annexed to the City of Caldwell, Idaho: A parcel of land situated in the North "A of the Southwest quarter of Section 35, Township 4 North, Range 3 West, Boise Meridian, Canyon County, Idaho and more particularly described as follows: Commencing at a Brass Cap monumenting the West % corner of said Section 35, T4NR3WBM which is the REAL POINT OF BEGINNING; thence along the north line of said SW % of Section 35, N 89 °58'30" E, 1323.38 feet to a 518" iron pin; thence S 89 0 53'16" E, 27.87 feet to a point; thence along a 231.22 radius curve to the right through a central angle of 21 °41'52 ", an arc distance of 87.56 feet, having a chord bearing of S 55 °28'16" E, 87.04 feet to a point; thence S 44 0 37'20" E, 762.32 feet to a point; thence S 39 0 38'43" E, 112.84 feet to a point; thence along a 802.12 feet radius curve to the right through a central angle of 20 °39'40 ", an arc distance of 289.25 feet a chord bearing of 6 S 29 °18'53" E, 287.68 feet to a point; thence S 18 °59'03" E, 332.71 feet to a point; thence S 28 0 12'23" E. 85.54 feet to a point; thence S 89 °59'26" W, 1006.83 feet to a 518" iron pin; thence N 00 °26'45" E, 329.97 feet to a 518" iron pin; thence N 89 °59'58" W, 1323.40 feet to a 518" iron pin on the centerline of Indiana Avenue; thence along said centerline, N 00 0 26'49" E, 989.35 feet to the REAL POINT OF BEGINNING. Said parcel contains 48.95 acres more or less and subject to all existing easements and rights -of -way. Together with all water, water rights, ditches and rights of way for ditches, appurtenant thereto or in anywise appertaining. SECTION 2. That the above - described real property be, and the same is hereby annexed and made a part of the City of Caldwell, Canyon County, Idaho. SECTION 3. That the real property herein by this ordinance annexed to the City of Caldwell hereinabove described shall be zoned and a part of the R -1 zoning district and the official zoning map is hereby amended accordingly. SECTION 4. That the City Engineer and the Planning and Zoning Director are hereby directed to alter all use and area maps as well as the official zoning maps, Comprehensive Plan and all official maps depicting the boundaries of the City of Caldwell in accordance with this ordinance. SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 6. This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell, including the lands herein annexed, with the following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code §63- 2219. z 6 0 PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this day of SAptembpr , 199.
