HomeMy WebLinkAboutORD 20980 0 BILL NO.34 ORDINANCE NO. 2098 AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO; AND THAT SAID LAND BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREAS TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO IDAHO CODE, SECTION 63 -2219. BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: SECTION 1. That the following described land is contiguous and adjacent to the City of Caldwell, Idaho on the North and that the City has received a request that said following described land should be annexed to the City of Caldwell, Idaho: A parcel of land situated in the NW Quarter of the SE Quarter of Section 33, T4NR3W, BM, Canyon County, Idaho, described in the Plat of Hill Drop Subdivision on Page 30 of Book 8 of Plats in the Canyon County Recorder's Office and Instrument Nos. 8821077, 711967, 9310035, 8616574, 9214299, 8618801, 9409001, 9409046, 9431682, 9406965, 94008584, 764490, 715103, and is more particularly described as follows; Commencing at the Northeast corner of the NW Quarter of the SE Quarter of said Section 33; said corner being the TRUE POINT OF BEGINNING; Thence S0 0 32'17 "W (formerly SO °03'E on the Plat of Hill Drop Subdivision) a distance of 1322.25 feet (formerly 1322.36 feet on said Plat of Hill Drop Subdivision) along the East boundary to the SE corner of said NW Quarter of the SE Quarter; Thence along the South boundary of said NW Quarter of the SE Quarter N89 °37'10 "W a distance of 664.68 feet; Thence N0 0 35'39 "E a distance of 660.94 feet to a point on the South ORDINANCE - Case No.95 -01 -AN Page 1 boundary of Hill Drop Subdivision, said point being on the East Right -of -Way line of Sunset Avenue; Thence along the South boundary of Hill Drop Subdivision N89 0 36'06 "W a distance of 56.00 feet to a point on a curve; Thence along the West boundary of Hill Drop Subdivision along a curve to the right a distance of 145.05 feet, said curve having a radius of 50.00 feet, a central angle of 166 0 12'56" and a long chord bearing N0 0 36'02 "E a distance of 99.28 feet; Thence continuing along the West boundary of Hill Drop Subdivision N0 0 36'02 "E a distance of 442.35 feet; Thence along the North boundary of Hill Drop Subdivision also being the North Right -of -Way line of West Spruce Street S89 0 35'34 "E a distance of 56.19 feet; Thence along a line parallel with the East boundary of said NW Quarter of the SE Quarter N0 7"E a distance of 120.00 feet to a point on the North boundary of said NW Quarter of the SE Quarter; Thence S89 0 35'34 "E along the North boundary of said NW Quarter of the SE Quarter a distance of 663.25 feet to the POINT OF BEGINNING. Said parcel contains 20.927 acres. Together with all water, water rights, ditches and rights of way for ditches, appurtenant thereto or in anywise appertaining. SECTION 2. That the above - described real property be, and the same is hereby annexed and made a part of the City of Caldwell, Canyon County, Idaho. SECTION 3. That the real property herein by this ordinance annexed to the City of Caldwell hereinabove described shall be zoned and a part of the R -1 zoning district and the official zoning map is hereby amended accordingly. SECTION 4. That the City Engineer and the Planning and Zoning Director are hereby directed to alter all use and area maps as well as the official zoning maps, Comprehensive Plan and all official maps depicting the boundaries of the City of Caldwell in accordance with this ordinance. SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 6. This ordinance shall be in full force and effect from and after its passage, ORDINANCE - Case No.95 -01 -AN Page 2 0 • approval and publication, according to law. SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell, including the lands herein annexed, with the following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall also file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code §63 -2219.
