ORDINANCE NO. 2096
AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT SAID LAND BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONING
DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR
PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER
AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK
OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND
MAP OF THE AREAS TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO
IDAHO CODE, SECTION 63 -2219.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
SECTION 1. That the following described land is contiguous and adjacent to the City of
Caldwell, Idaho on the East and South and that the City has received a request that said
following described land should be annexed to the City of Caldwell, Idaho:
Rosewood Subdivision, A platted parcel of land situated in the SW 1/4 of the
SW 1/4 of Section 34, T 4N R 3W, BM, Canyon County, Idaho. Said parcel
is a portion of that certain tract described in Instrument No. 548948 Dated
April 24, 1964, and is more particularly described as follows:
Beginning at the S.W. Corner of said Section 34; Thence N 89 20' 30" E,
along the centerline of Ustick Road, a distance of 333.59 feet to the
intersection of Ustick Road and Brian Avenue, which is the Point of
Beginning;
Thence N 0 12" 30" W, along of Brian Avenue, a distance of 705.32 feet
to a point on the south boundary of McCarthy Subdivision, as shown in
Instrument # 528790; Thence N 61 ° 00' 45" E, along southerly boundary of
said McCarthy Subdivision, a distance of 378.32 feet to a point on the
centerline of Ray Avenue; Thence S 0 12' 30" E, along said centerline of
Ray Avenue a distance of 76.49 feet, Thence a distance of 202.60 feet,

along the said centerline of Ray Avenue, on a curve to the left with a radius
of 399.83 feet and whose long chord bears S 14 43' 30" E, and a long
chord distance of 187.91 feet; Thence S 29 14' 30" E, along the said
centerline of Ray Avenue a distance of 425.72 feet; Thence a distance of
89.29 feet, along said centerline of Ray Avenue, on a curve to the right with
a radius of 176.20 feet, and whose long chord bears S 14° 43' 30" E, and a
long chord distance of 88.83 feet; Thence S 0 12' 30" E, along said
centerline of Ray Avenue a distance of 166.07 feet, to the point of
intersection of Ustick Road centerline and Ray Avenue centerline; Thence
S 89 20' 30" W, along the centerline of Ustick Road a distance of 607.59
feet to the Point of Beginning.
Together with all water, water rights, ditches and rights of way for ditches,
appurtenant thereto or in anywise appertaining.
This parcel contains approximately 9.25 acres.
SECTION 2. That the above - described real property be, and the same is hereby annexed
and made a part of the City of Caldwell, Canyon County, Idaho.
SECTION 3. That the real property herein by this ordinance annexed to the City of
Caldwell hereinabove described shall be zoned and a part of the R -1 zoning district and
the official zoning map is hereby amended accordingly.
SECTION 4. That the City Engineer and the Planning and Zoning Director are hereby
directed to alter all use and area maps as well as the official zoning maps, Comprehensive
Plan and all official maps depicting the boundaries of the City of Caldwell in accordance
with this ordinance.
SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 6. This ordinance shall be in full force and effect from and after its passage,
approval and publication, according to law.
SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective
date of this ordinance, duly file a certified copy of this ordinance and a map prepared in
a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell,
including the lands herein annexed, with the following officials of the County of Canyon,
State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall also file
simultaneously a certified copy of this ordinance with the State Tax Commission of the
State of Idaho, all in compliance with Idaho Code §63 -2219.
