ORDINANCE NO. 2089
AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT SAID LAND BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONING
DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR
PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER
AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK
OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND
MAP OF THE AREAS TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO, PURSUANT TO
IDAHO CODE, SECTION 63 -2219.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
SECTION 1. That the following described land is contiguous and adjacent to the City of
Caldwell, Idaho on the West and South and that the City has received a request that said
following described land should be annexed to the City of Caldwell, Idaho:
A parcel of land being that part of the NE 1/4 SE 1/4 lying South and West of Canyon Hill
Ditch in Section 23, T4NR3W, BM, Canyon County, State of Idaho and more particularly
described as follows:
COMMENCING at the Southwest comer said NW 1/4 SE 1/4 marked by a 5/8" iron
pin as described in Instrument number 8426679, said corner being the intersection
of Florida Avenue and Owyhee Lane;
Thence N 89 57'23" E along the centerline of Owyhee Lane a distance of 1320.33
feet, (formerly 1320.00 feet), said centerline being the Southerly boundary of said
NW 1/4 SE 1/4 to the Southeast comer of the NW 1/4 SE 1/4, marked by a 1/2" iron
pin as described in Instrument No. 8426679, said corner being the East end of the
centerline of Owyhee Lane as shown on the plat of Hillcrest Subdivision (Book 3,
Page 10 of Plats of Canyon County, Idaho) and also the TRUE POINT OF
BEGINNING.

Thence N 0 30'28" E along the East boundary of said NW 1/4 SE 1/4 a distance
of 449.11 feet to a point on the centerline of Canyon Hill Ditch, thence traversing
said ditch centerline:
S 37° 26' 51" E a distance of 99.36 feet,
Thence 138.44 feet along the arc of a curve to the right, said curve having a radius
of 230.00 feet, a central angle of 34 29' 14 ", and a long chord bearing S 22 0' 51"
E a distance of 136.36 feet,
Thence S 2° 51' 22" E a distance of 112.73 feet,
Thence S 12 16'50" E a distance of 134.16 feet, to a point on the south boundary
of said NW 1/4 SE 1/4;
Thence leaving the centerline of said ditch S 89 57' 23" W along the South
boundary of said NW 1/4 SE 1/4 a distance of 149.66 feet to the POINT OF
BEGINNING. This parcel contains 1.04 acres.
Together with all water, water rights, ditches and rights of way for ditches,
appurtenant thereto or in anywise appertaining.
SECTION 2. That the above - described real property be, and the same is hereby annexed
and made a part of the City of Caldwell, Canyon County, Idaho.
SECTION 3. That the real property herein by this ordinance annexed to the City of
Caldwell hereinabove described shall be zoned and a part of the R -1 zoning district and
the official zoning map is hereby amended accordingly.
SECTION 4. That the City Engineer and the Planning and Zoning Director are hereby
directed to alter all use and area maps as well as the official zoning maps, Comprehensive
Plan and all official maps depicting the boundaries of the City of Caldwell in accordance
with this ordinance.
SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 6. This ordinance shall be in full force and effect from and after its passage,
approval and publication, according to law.
SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective
date of this ordinance, duly file a certified copy of this ordinance and a map prepared in
a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell,

including the lands herein annexed, with the following officials of the County of Canyon,
State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall also file
simultaneously a certified copy of this ordinance with the State Tax Commission of the
State of Idaho, all in compliance with Idaho Code §63 -2219.
