ORDINANCE NO. 2076
AN ORDINANCE TO AMEND CHAPTER 11, ARTICLE 2, SECTION 4, SUBSECTION
6, OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO, PERTAINING TO PRELIMINARY PLAT APPROVALS,
TIME FRAMES IN WHICH TO RECORD A FINAL PLAT AND PROCEDURES FOR
GRANTING AN EXTENSION OF TIME IN WHICH TO RECORD A FINAL PLAT;
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF
IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Chapter 11, Article 2, Section 4, Subsection 6 of the Municipal Code
of the City of Caldwell, County of Idaho, shall be amended by adding or deleting certain
language as follows:
A. The basic conditions under which preliminary approval of the
preliminary plat is granted will not be changed ptier to expifatien
date unless authorized by the Commission
B. Approval is valid for a period of twelve ("` twenty -four (24) months from
date of Commission action. Failure to obtain final plat approval and to
record the final plat or any portion or phase thereof in accordance with
provisions of the Subdivision Ordinance of the City of Caldwell within said
prescribed time frame shall cause the preliminary plat to be null and void,
unless an extension of time is applied for by the subdivider and granted
by either the Planning and Zoning Director or the Planning and Zoninq
Commission.
C. Preliminary Plat time extensions are to be considered in increments of
one (1) year and may be granted administratively by the Planning and
Zoning Director in accordance with Section 10 -03 -02 of the Zoninq
Ordinance provided the basic circumstances and conditions upon which
preliminary plat approval was granted have not changed.
D. Preliminary approval in itself does not assure final acceptance of streets
for dedication or continuation of existing zoning requirements for the tract
to its environs.
Section 2. All ordinances or parts of ordinances inconsistent are hereby repealed.

Section 3. This ordinance shall be in full force and effect from and after its passage,
approval and publication according to law.
