ORDINANCE NO.
AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT SAID LAND BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY RESIDENTIAL) ZONING
DISTRICT; AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON
COUNTY, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR
PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER
AND PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE
OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE
CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREAS TO BE ANNEXED WITH CANYON COUNTY,
STATE OF IDAHO AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO,
PURSUANT TO IDAHO CODE, SECTION 63 -2215.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
SECTION 1. That the following described land is contiguous and adjacent to the City
of Caldwell, Idaho on the North, East and South; and that the City has determined the
property to be urban in character with the benefit and availability of municipal services
and that said following described land should be annexed to the City of Caldwell, Idaho:
Said property consists of approximately 15 acres and is located generally north of West
Logan Street east and west of the Marshall Avenue extension; and on the west side of
Marshall Avenue north of West Ash Street. Said property is more particularly described
as follows:
Parcel I
COMMENCING at the West Quarter comer of Section 28, Township 4
North, Range 3 West, of the Boise Meridian;
thence South 89 55' East a distance of 695 feet;
thence North 0 05' East a distance of 460 feet to a point on the southerly
boundary line of Block 45, Pioneer Subdivision extended, which is the
POINT OF BEGINNING;
thence continuing North 0 05' East a distance of 248.8 feet to a point on
the south boundary of Block 19, Park West Addition;
thence South 89 55' East a distance of 30 feet;
thence South 0 05' West a distance of 100 feet to a point on the south

boundary line of the Parker Drain;
thence South 89 55' East a distance of 995 feet along said south
boundary line to a point being 930 feet East of the East boundary line of
Block 44, Pioneer Subdivision and being in line with the boundary line
common to Block 2 and Block 3, Pioneer Subdivision;
thence South 0 05' West a distance of 602.8 feet to the southeastern
comer of Block 3, Pioneer Subdivision, said point also being on the south
Quarter Section line of the Northwest Quarter of Section 28 and also being
on the center line of West Logan Street;
thence N 89 55' W a distance of 530 feet to a point being 10 feet east of
the west boundary line of Block 4, Pioneer $ubdivision and on the center
line of West Logan Street;
thence N 0 05' E 422.52 feet to a point on the south boundary line of
Block 45, Pioneer Subdivision;
thence N 86 16' 48" W along the south boundary line of Block 45 a
distance of 496 feet to the POINT OF BEGINNING.
Parcel II
BEGINNING at the intersection of Ash Street and Marshall Avenue which is the West
1/16TH comer of Section 28, Township 4 North, Range 3 West, of the Boise Meridian;
thence North 89 53' 31" West a distance of 660.65 feet to a point being
on the center line of Dorman Avenue;
thence North 0 05' West a distance of 636.91 feet to a point;
thence South 89 55' East a distance of 660.85 feet to the center line of
Marshall Avenue;
thence South 0 05' East a distance of 636.83 feet to the intersection of
Ash Street and Marshall Avenue, which is THE POINT OF BEGINNING.
Together with all and singular the tenements, hereditament and
appurtenances thereunto belonging or in anywise appertaining;
SECTION 2. That the above- described real property be and the same is hereby
annexed and made a part of the City of Caldwell, Canyon County, Idaho.
SECTION 3. That the real property herein by this ordinance annexed to the City of
Caldwell hereinabove described shall be zoned and a part of the R -1 zoning district and
the official zoning map is hereby amended accordingly.
SECTION 4. That the City Engineer and the Planning and Zoning Director is hereby
directed to alter all use and area maps as well as the official zoning maps,
comprehensive plan and all official maps depicting the boundaries of the City of Caldwell
in accordance with this ordinance.

SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 6. This ordinance shall be in full force and effect from and after its passage,
approval and publication, according to law.
SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective
date of this ordinance, duly file a certified copy of this ordinance and a map prepared
in a draftsman manner plainly and clearly designating the boundaries of the City of
Caldwell, including the lands herein annexed, with the following officials of the County
of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and
shall also file simultaneously a certified copy of this ordinance with State Tax
Commission of the State of Idaho, all in compliance with Idaho Code §63 -2215.
