ORDINANCE NO. 2041
AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT SAID LAND BE ANNEXED TO THE CITY
OF CALDWELL, IDAHO; AND DECLARING SAID LAND BY PROPER LEGAL
DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO, AS PART OF THE R -1 (SINGLE FAMILY
RESIDENTIAL), R -S (SEMI -RURAL RESIDENTIAL) AND R -S-2 (SEMI -RURAL
RESIDENTIAL; APPROXIMATELY TWO DWELLING UNITS PER ACRE) ZONING
DISTRICTS; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER AND
PLANNING AND ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL
MAPS OF THE CITY OF CALDWELL, IDAHO; AND DIRECTING THE CLERK OF
THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE ORDINANCE AND
MAP OF THE AREAS TO BE ANNEXED WITH CANYON COUNTY, STATE OF
IDAHO AND THE STATE TAX COMMISSION OF THE STATE OF IDAHO,
PURSUANT TO IDAHO CODE, SECTION 63 -2215.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
SECTION 1. That the following described land is contiguous and adjacent to the City
of Caldwell, Idaho on the North; and that the property owners have requested that
said following described land should be annexed to the City of Caldwell, Idaho:
Said property consists of approximately 200 acres and is located generally west of the
Dixie Drain between Jefferson Junior High School and Ustick Road; east of 10th
Avenue between Ustick Road and Homedale Road, and the northwest corner of
Homedale Road and Montana Avenue. Said property is more particularly described
as follows:
PARCEL I
A parcel of land situated in the southwest quarter of Section 34, T4NR3W,
BM, Canyon County, Idaho. Said parcel is described in Instrument No.
901734 recorded September 11, 1980 and is more particularly described as
follows:
Commencing at the southwest corner of said Section 34; thence
N89 0 20'30 "E along the south boundary of said southwest quarter a distance
of 944.18 feet to the REAL POINT OF BEGINNING;

Thence North 0 12'30 "W a distance of 166.27 feet (formerly 166.07');
thence 89.28 feet along a curve to the left with a radius of 176.20 feet and
long chord bearing North 14 0 43'30° West a distance of 88.33 feet; thence
North 29 0 14'30" West a distance of 425.72 feet; thence 202.60 feet along
a curve to the right with a radius of 399.83 feet and a long chord bearing
North 14 West a distance of 200.44 feet; thence North 0
West a distance of 76.49 feet to the centerline of a drain ditch; thence along
said centerline North 61 0 00'45" East a distance of 136.38 feet; thence
continuing along said centerline North 20 East a distance of 383.42
feet; thence leaving said centerline North 89 0 24'30" East a distance of
527.86 feet to a point on the centerline of the Caldwell Low Line Canal;
thence along said centerline South 11 °36' East a distance of 408.86 feet;
thence continuing along said centerline South 49 0 25' East a distance of
289.73 feet to a point on the centerline of a drain ditch; thence along said
centerline South 1 0 41'45" West a distance of 727.02 feet (formerly 723.08
feet) to a point on the south boundary of said southwest quarter; thence
along said south boundary South 89 0 20'30" West a distance of 778.77 feet
to the TRUE POINT OF BEGINNING. Said parcel contains 24.490 acres
more or less.
PARCEL II
Government Lot 4 and the Southwest Quarter of the Northwest Quarter in
Section 3, Township 3 North, Range 3 West, Boise Meridian, Canyon
County, Idaho.
PARCEL III
This parcel is a portion of the Southwest Quarter of Section 3, Township 3
North, Range 3 West, Boise Meridian, Canyon County, Idaho, and is more
particularly described as follows:
The East half of the Southwest Quarter of said Southwest Quarter of
Section 3, the West half of the Southeast Quarter of said Southwest
Quarter of Section 3. The Northwest Quarter of said Southwest Quarter of
Section 3.
EXCEPTING the following described parcel:
This parcel is a portion of the Northwest Quarter of the Southwest quarter
Section 3 Township 3 North, Range 3 West of the Boise Meridian, and is
more particularly descirbed as follows:
BEGINNING at the Southwest corner of said Northwest Quarter of
Southwest Quarter;
Thence continuing North 0 0 21'00 "West, a distance of 578.42 feet to the

centerline of the Phyllis Canal: Thence South 60 0 21'51" East, along the
centerline of the Phyllis Canal, a distance of 40.74 feet: Thence South
53 0 02'00" East, along the centerline of the Phyllis Canal, a distance of
76.41 feet: Thence Southeasterly, a distance of 128.56 feet along the arc
of a curve to the right having a radius of 900 feet, a central angle of
8 and a long chord which bears South 48 0 56'29" East, a distance
of 128.45 feet: Thence South 44 0 50'57" East, along the centerline of the
Phyllis Canal, a distance of 250.17 feet: Thence Southeasterly, a distance
of 29.42 feet along the arc of a curve to the left having a radius of 725.00
feet, a central angle of 2 0 19'29" and a long chord which bears South
46 East, a distance of 29.41 feet: Thence Southeasterly a distance
of 131.47 feet along the arc of a curve to the left having a radius of 725.00
feet, a central angle of 10 0 2325" and along chord which bears South
52 0 22'08" East, a distance of 131.29 Feet; Thence South 57 0 33'51" East,
along the centerline of the Phyllis Canal, a distance of 180.27 feet; Thence
South 60 0 30'49" East, along the centerline of the Phyllis Canal, a distance
of 88.85 feet to the South boundary of said NorthWest Quarter Southwest
Quarter: Thence South 89 0 14'22" West along the south boundary of said
Northwest Quarter Southwest quarter, a distance of 720.91' to the POINT
OF BEGINNING.
PARCEL IV
The East Half of the Southeast Quarter of the Southwest Quarter in Section
3, Township 3 North, Range 3 West of the Boise Meridian, Canyon County,
Idaho.
EXCEPTING the following described parcel:
This parcel is a portion of the Southeast Quarter of the Southwest Quarter,
Section 3, Township 3 North, Range 3 West, Boise Meridian, Canyon
County, Idaho, and is more particularly described as follows:
BEGINNING at the Southeast corner of said Southeast Quarter of the
Southwest Quarter; thence South 89 0 01'00" West along the Southerly
boundary of said Southeast Quarter of the Southwest Quarter a distance of
215.71 feet; thence North 01 ° 35'12" East a distance of 207.78 feet; thence
South 89 19'41" East a distance of 208.26 feet to the Easterly boundary of
said Southeast Quarter of the Southwest Quarter; thence South 0 0 28'35"
East along said Easterly boundary a distance of 201.56 feet to the POINT
OF BEGINNING.
Together with all water, water rights, ditches and rights of way for ditches, appurtenant
thereto or in anywise appertaining.
All parcels to include to the centerline of adjoining street rights -of -way.
ORDINANCE - P.3
SECTION 2. That the above - described real property be and the same is hereby
annexed and made a part of the City of Caldwell, Canyon County, Idaho.
SECTION 3. That the real property herein by this ordinance annexed to the City of
Caldwell hereinabove described shall be zoned and a part of the R -1, R -S and R -S -2
zoning district and the official zoning map is hereby amended accordingly.
SECTION 4. That the City Engineer and the Planning and Zoning Director is hereby
directed to alter all use and area maps as well as the official zoning maps,
comprehensive plan and all official maps depicting the boundaries of the City of Caldwell
in accordance with this ordinance.
SECTION 5. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 6. This ordinance shall be in full force and effect from and after its passage,
approval and publication, according to law.
SECTION 7. The Clerk of the City of Caldwell shall, within 10 days following the effective
date of this ordinance, duly file a certified copy of this ordinance and a map prepared in
a draftsman manner plainly and clearly designating the boundaries of the City of Caldwell,
including the lands herein annexed, with the following officials of the County of Canyon,
State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall also file
simultaneously a certified copy of this ordinance with State Tax Commission of the State
of Idaho, all in compliance with Idaho Code §63 -2215.
