ORDINANCE NO. 2040
AN ORDINANCE TO AMEND PORTIONS OF TITLE VI, CHAPTER 1, CHAPTER 2,
CHAPTER 3 AND CHAPTER 4, OF THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, PERTAINING TO
PURPOSE, LAND USE SCHEDULE, HEIGHT, SETBACK AND AREA SCHEDULE,
AND SIGN SCHEDULE, IN ASSOCIATION WITH THE ESTABLISHMENT OF THE
RS (SEMI -RURAL RESIDENTIAL) ZONING DISTRICT: REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT
HEREWITH.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF
THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Section 6 -1 -4 of the Municipal Code of the City of Caldwell, County
of Idaho, shall be amended by adding certain language as follows:
R -S SEMI -RURAL RESIDENTIAL: The purpose of the R -S (Semi -Rural
Residential) zone is to provide areas by zoning procedures and in
accordance with the Comprehensive Plan that help to protect and
enhance single family living areas that are rural or agricultural in
character and transitional in relationship to more urbanized residential
areas of higher density. Such areas may not necessarily have a full
range of urban services contingent upon togocLraphy, density, lot size,
development designs and other development and engineering criteria
being properly met.
A sub -zone classification is created within the R -S zone to define maximum
limits of residential density as a means to provide a greater degree of
development predictability regarding traffic generation, availability of City
services and land use compatibility.
1. R -S -2 Semi -Rural Residential: very low density range, approximately two
(2) dwelling units per acre.
Section 2. That Section 6 -2 -1 Table 1 Land Use Schedule of the Municipal Code of
the City of Caldwell, County of Canyon, State of Idaho, shall be amended by adding
certain language as follows:

Section 4. That Section 6 -2 -1 Table 4 Sign Schedule of the Caldwell Zoning Ordinance
be amended by adding certain language as follows:
R -S, R -1, R -2 One name sign or home occupation sign for each dwelling unit. The
sign shall not be more than 2 square feet in area and shall be
unlighted and attached flush to the building.
One temporary sign advertising the sale, lease or rental of the
property on which it is located. The sign shall not be more than 4
1/2 square feet in area and shall not be illuminated.
One temporary sign advertising the sale of a tract of land or a
subdivision. The sign shall not be more than 32 square feet in area
and shall not be illuminated and shall be set back at least 30 feet
from property lines.
A sign identifying a special use shall be permitted. The sign shall not
be more than 32 square feet in area, shall not be illuminated, and

shall be set back at least 10 feet from the property lines (Ord. 1651,
7-5-83)....
..NOTE: 3. Off- premise signs shall not be permitted in the R -S and R -1
Residential Zones. They shall not be permitted in the R -2 and R -3
Residential Zones unless approved by special permit.
Section 5. That Section 6- 3 -1(4) of the Caldwell Zoning Ordinance shall be amended by
adding certain language as follows:
In the R -S and R -1 Residential Zones, the height of an outbuilding not used
as a dwelling shall not exceed fifteen feet (15') except by special use
permit.
Section 6. All ordinances or parts of ordinances inconsistent are hereby repealed.
Section 7. This ordinance shall be in full force and effect from and after its passage,
approval and publication according to law.
