ORDINANCE NO. 2038
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL, IDAHO FROM COUNTY R -1 TO R -1 (SINGLE FAMILY
RESIDENTIAL); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST
INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING
AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS R -1 ON THE
OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND
RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, Idaho;
WHEREAS, it has been determined by the City Council of the City of Caldwell,
Idaho, upon the recommendation of the Planning and Zoning Commission and
following the public hearing procedures as required in Section 6-43 Caldwell Code,
that the following described property be rezoned from County R -1 to R -1 (Single
Family Residential) and that said rezoning is in the best interest of the City of
Caldwell, Idaho.
Said property consists of 5.02 acres and is located generally on the north and south
side of Spruce Street between Arlington Avenue and 10th Avenue as shown on
attached Exhibit "A" which is made part of this Ordinance.
IT IS HEREBY ORDAINED AS FOLLOWS:
Section 1. That certain land described above is now zoned R -1 (Single Family
Residential) after the date of this ordinance.
Section 2. The Planning and Zoning Director of the City of Caldwell is hereby
instructed to so designate the same above described property on the official zoning
map of the City of Caldwell, Idaho, as being R -1.
Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
Section 4. This ordinance shall be in full force and effect from and after its passage.
