ORDINANCE NO. 2030
AN ORDINANCE TO AMEND A PORTION OF TITLE II, CHAPTER 2, PERTAINING
TO APPEALS TO COUNCIL, OF THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF IN CONFLICT
HEREWITH.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF
THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Section 2 -2-6 of the Municipal Code of the City of Caldwell, County
of Idaho, shall be amended by adding and deleting certain language as follows:
"2 -2-6 APPEALS TO COUNCIL: The Clot Council shall hear all appeals
from a decision of the Planning and Zoning Commission concerning
special use permits and variances and shall have the power to permit
special exceptions to the terms of the zoning regulations. All -de^' i
Fiembers. The Council may uphold, reverse, or modify the action of the
Commission. All decisions of the Council to uphold reverse or modify a
decision of the Planning and Zoning Commission concerning special
use permits and variances shall be by a majority vote of the presiding
Council members. It is not necessary for all six (6) Council members to
be in attendance at the Council meeting when an appeal is presented.
In the event of a tie vote. the Mayor may elect to vote in order to break a
tie..
Section 2. All ordinances or parts of ordinances inconsistent are hereby repealed.
Section 3. This ordinance shall be in full force and effect from and after its passage,
approval and publication according to law. .
