ORDINANCE NO. 1979
AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, STATE OF IDAHO, BY DELETING AND ADDING CERTAIN
LANGUAGE IN TITLE XI, CHAPTER 14, PERTAINING TO BICYLES
BY REPEALING SECTIONS 11 -14 -2 THROUGH 11 -14 -8 REGARDING
LICENSE REQUIRED; APPLICATION; ISSUANCE, ATTACHMENT OF
LICENSE PLATE; INSPECTION; AND TRANSFER OF OWNERSHIP AND
ADDING NEW SECTIONS 11 -14 -2 THROUGH 11 -14 -8 REGARDING
REGISTRATION OF BICYCLE; APPLICATION /REGISTRATION;
ISSUANCE; INSPECTION; TRANSFER OF OWNERSHIP AND RENTAL
AGENCIES: REPEALING ALL ORDINANCES, RESOLUTIONS, ORDER OR
PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Section 2 of Chapter 14, Title XI be repealed
and a new Section 2 be added as follows:

11 -14 -2: REGISTRATION OF BICYCLE: Every person
residing in the Municipality should register
their bicycle with the City Police Department.
The purpose of registering bicycles is to
afford the Police Department tracing capabiity
for lost stolen or found bicycles.
Section 2. That Section 3 of Chapter 14, Title XI be repealed
and a new Section 3 be added as follows:

11 -14 -3: APPLICATION /REGISTRATION• The Caldwell Police Department
will furnish a form for registration. There is no fee
for registration.

Section 3. That Section 4 of Chapter 14, Title XI be repealed
and a new Section 4 be added as follows:

11 -14 -4: ISSUANCE:
(AZ Upon receiving the registration
information, it will be the
responsibility of police personnel
to enter said information into the
Caldwell Police Department in -house
computer system in a timely manner.
The registration is effective for
the life of the bicycle or until the
bicycle ownership changes.

provided by the Police Department
and will include ownership and
bicycle description information.
The registration form shall be done
in duplicate and the bicycle owner

Section 4. That Section 5 of Chapter 14, Title XI be repealed
and a new Section 5 be added as follows:

11 -14 -5: INSPECTION: At the request of the owner, any
police officer can inspect the bicycle for
safety. However, it is the responsibility of
the bicycle owner to keep the bicycle in a
safe mechanical condition.
Section 5. That Section 6 of Chapter 14, Title XI, be
repealed and a new Section 6 be added as follows:

11 -14 -6: TRANSFER OF OWNERSHIP: Upon the sale of
transfer of ownership of said bicycle, it
shall be the responsibility of the new owner
to change the records information at the
Police Department.
Section 6. That Section 7 of Chapter 14, Title XI, be
repealed and a new Section 7 be added as follows:

11 -14 -7: RENTAL AGENCIES: A rental agency shall not
rent or offer for rent any bicycle that is not
in safe working order. Said agency shall
maintain company records to identify all
bicycles under their control.
Section 7. All ordinances or parts of ordinances inconcistent
herewith are hereby repealed.
Section 8. This ordinance shall be in full force and effect
from and after its passage, approval, and publication according to
law.
