ORDINANCE NO. 19 73
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL, IDAHO FROM R -2T (COMBINED MEDIUM DENSITY
RESIDENTIAL, TRAILER OVERLAY) TO M -1T (LIGHT INDUSTRIAL, TRAILER
OVERLAY); DETERMINING THAT SAID CHANGE IN ZONING IS IN CONFORMANCE
WITH THE COMPREHENSIVE PLAN AND IS IN THE BEST INTEREST OF THE CITY
OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR
TO DESIGNATE SAID PROPERTY AS MAT ON THE OFFICIAL ZONING MAP AND
REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT
HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, Idaho;
WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho,
upon the recommendation of the Planning and Zoning Commission and following the
public hearing procedures as required in Section 6 -4 -3 Caldwell Municipal Code, that the
following described property be rezoned from R -2T (Combined Medium Density
Residential, Trailer Overlay) to M -1 T (Light Industrial/Trailer Overlay) and that said
rezoning is in the best interest of the City of Caldwell, Idaho.
Said property is described as:
All that part of Block 55 of GOLDEN GATE ADDITION to CALDWELL,
IDAHO, according to the official Plat of said Addition on file and of record
in the office of the County Recorder of Canyon County, Idaho, described
as follows:
BEGINNING at the Easterly corner of said Block 55 and running thence
Southwesterly along the Southeasterly boundary line of said Block 55 a
distance of 296 feet to the Southerly corner of said Block 55; thence
running Northwesterly along the Southwesterly boundary line of said Block
55 a distance of 255 feet to a point which is 85 feet Southeasterly from the
Westerly corner of said Block 55; thence running in a Northerly direction to
a point in the Northeasterly boundary line of said Block 55 which is 10 feet
Southeasterly from the Northerly corner of said Block 55; thence running
Southeasterly along the Northeasterly boundary line a distance of 330 feet
to the POINT OF BEGINNING.
EXCEPTING THEREFROM:
BEGINNING at the Northeasterly corner of Block 55 of GOLDEN GATE
ADDITION to CITY OF CALDWELL, IDAHO, according to the PLAT of said
ADDITION filed December 21, 1907 in Book 2 of Plats at page 78, in the
office of the County Recorder, Canyon County, Idaho, said point being
between Block 55 and 63 on the Northerly side of 3rd Avenue. Thence
Northwesterly between Block 55 and 63 a distance of 135 feet; thence in a
Southwesterly direction parallel with 3rd Avenue a distance of 208 feet;
thence Southeasterly parallel to the Block line between Block 55 and 63 a
distance of 135 feet to the Northerly line of 3rd Avenue; thence in a
Northeasterly direction following the Northerly line of 3rd Avenue a distance
of 208 feet to the POINT OF BEGINNING.
IT IS HEREBY ORDAINED AS FOLLOWS:
Section 1. That certain land described above is now zoned M -1 T(Light Industrial, Trailer
Overlay) after the date of this ordinance.
Section 2. The Planning and Zoning Director of the City of Caldwell is hereby instructed
to so designate the same above described property on the official zoning map of the City
of Caldwell, Idaho, as being M -1 T.
Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
Section 4. This ordinance shall be in full force and effect from and after its passage.
PASSED BY THE COUNCIL of the City of Caldwell, Idaho, this 7 th day of
