ORDINANCE NO. 1972
AN ORDINANCE DETERMINING THAT CERTAIN LAND LIES CONTIGUOUS OR
ADJACENT TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO; AND THAT THE OWNERS OF SAID LAND HAVE
CONSENTED AND AGREED THAT SAID LAND BE ANNEXED TO THE CITY OF
CALDWELL, IDAHO, AS PART OF THE R -2 MEDIUM DENSITY RESIDENTIAL ZONE;
AND DECLARING SAID LAND BY PROPER LEGAL DESCRIPTION AS DESCRIBED
BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN
CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO.
BE IT ORDAINED, BY THE MAYOR AND THE COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
SECTION 1. That the following described land is contiguous and adjacent to the City of
Caldwell, Idaho on the East and West; and that the owners of said land have requested
and consented that said following described land should be annexed to the City of
Caldwell, Idaho:
Commencing at the Northwest corner of the South '/2 of the SW '/a of the
NE' /4 of Section 35, Township 4 North, Range 3 West, Boise Meridian, and
bearing thence South 286.61 feet along the West boundary line of said
South '/2 SW '/4 NE 1 /4 to the REAL POINT OF BEGINNING;
Thence continuing South 264.52 feet along the West boundary line of the
said S 1 /2 SW '/4 NE 1 /4 to a point;
Thence East 1,110 feet on a line parallel with the North boundary line of
said S 1 /2 SW '/4 NE '/a to the center of the right of way of the Wilson Drain;
Thence North 16 °40' West 276.3 feet along the center of the right of way of
Wilson Drain;
Thence West 1,030.8 feet on a line parallel with the North boundary line of
said S 1 /2 SW '/4 NE 1 /4 to the REAL POINT OF BEGINNING.
Together with all water, water rights, ditches and ditch rights appurtenant
thereto or used in connection therewith.
The annexed parcel shall include areas to the centerline of S. Florida Avenue.
SECTION 2. It is heris declared by the Mayor and Coup of the City of Caldwell,
Idaho, that the land described above by property legal description is hereby declared to
be a part of the City of Caldwell, Canyon County, Idaho.
SECTION 3. It is further declared that said land described above shall hereby be made
part of the R -2 Medium Density Residential zone.
SECTION 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are
hereby repealed, rescinded and annulled.
SECTION 5. This ordinance shall be in full force and effect from and after its passage,
approval and publication, according to law.
SECTION 6. The land described in this ordinance shall be added to the official City
maps by the City Engineer and shall be subject to taxation as other property and persons
within the corporate limits of the City of Caldwell, Canyon County, Idaho, upon filing of
a certified copy of this ordinance with the County Recorder and County Assessor of the
County of Canyon, State of Idaho, and the State Tax Commission, State of Idaho.
