HomeMy WebLinkAboutORD 1964%ILL NO. 28 ORDINANCE NO. 1964 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO FROM R -2 (COMBINED MEDIUM DENSITY RESIDENTIAL) TO R-3 (MULTI - FAMILY HIGH DENSITY RESIDENTIAL); DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; INSTRUCTING THE PLANNING AND ZONING DIRECTOR TO DESIGNATE SAID PROPERTY AS R-3 ON THE OFFICIAL ZONING MAP AND REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, Idaho; WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon the recommendation of the Planning and Zoning Commission and following the public hearing procedures as required in Section 6 -4-3 Caldwell Code, that the following described property be rezoned from R -2 (Combined Medium Density Residential) to R -3 (Multi - Family High Density Residential) and that said rezoning is in the best interest of the City of Caldwell, Idaho. Said property is located generally at the northwest corner of Indiana Avenue and Linden Street (2420 South Indiana) and is more particularly described as follows: Beginning at a point 25 ft. north and 30 ft. west of the southeast corner of Sec.27 in Twp. 4 N.R. 3 W.B.M., and running thence North along the Westem boundary line of Indiana Avenue a distance of 140.4 ft; thence West a distance of 135.3 ft; thence South a distance of 140.4 ft. to the North boundary line of Linden Street; thence East along the North boundary line of said Linden Street a distance of 135.3 ft., to the place of beginning containing 0.4368 acres, more or less; The above described premises is the same property as that which is also described as Lots 16, 17, 18, 19 and 20 of Block 21 of College Heights Addition to the City of Caldwell; and South 8 ft. of vacated alley adjacent thereto; IT IS HEREBY ORDAINED AS FOLLOWS: Section 1. That certain land described above is now zoned R -3 (Multi - Family High Density Residential) after the date of this ordinance. Section 2. The Planning and Zoning Director of the City of Caldwell is hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho, as being R -3. 1 Section 3. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 4. This ordinance shall be in full force and effect from and after its passage. PASSED BY THE COUNCIL of the City of Caldwell, Idaho, this 2 1St day of September , 1992.
